運動領域的法律與道德問題─以運動槍手為例

摘要

運動精神、運動道德，是參與運動賽事或從事運動競技者，形而上的思想，也是常掛在嘴邊的精神口號。許多時候，似乎難以對其下完整的定義或舉例；但是，我們卻忽略了，運動規範，已經將其部分，具體地明文化。本文，除討論運動道德在運動規範中的具體展現外，更以「幽靈人口」為身份之運動槍手為例，討論違反該運動規範之行為，可能涉及的刑法問題。然而，運動道德、運動規範，或所謂運動法律，約束著運動員種種行為，似乎箝制了運動員之自由，拘束了運動之發展。本文引用「法律社會功能」概念，來說明運動道德、規範與法律，是締造自由，而非拘束自由。

Sportsmanship and sports ethics are the metaphysical philosophy and spirit slogans of athletes. Sometimes, we will find difficult to define them and give an example. However, we usually ignore them present to the sports rules. In this paper, we not only discuss the relationship between sports ethics and sports rules, but also discuss the relationship between sports rules and criminal law by the ＂fake household registration＂ style of sports cheaters. The acts of athletes are restricted by sports ethics, sports rules and sports law. It seems to limit the liberty of athletes and restrain the developments of sports. In this text, we will discuss the concept of ＂Social Function of law＂, and make a description of that sports ethics, sports rules and sports law are creating liberties, rather than limiting.
