從美國民權法反性別就業歧視看勞動合同法制定後之反性別就業歧視

A Visit of Chinese Anti-gender Employment Discrimination After its Passage of Labor Contract Law: From the Perspective of the US Civil Right Act's Anti-gender Employment Discrimination

摘要


美國法強調公平就業(fair employment),或以就業機會平等(Equal Employment Opportunity)稱之。因而,就業平等僅在於職業開放給有才能的人(career open to the talent s)才展現其性質。而機會平等之實益在於個人有機會獲得正面之社會流動。其民權法規範之反性別就業歧視制度,含有同工同酬原則規範、各種與懷孕、妊娠與育兒有關之保護制度、反性騷擾。中國在勞動合同法公布施行後其《婦女權益保障法》、《就業促進法》、《女職工勞動保護規定》、《女職工禁忌勞動範圍規定》在性性別就業歧視之禁止、同工同酬原則規範、各種與懷孕、妊娠與育兒有關之母性保護制度、性別差異特別保護制度與其他反性別就業歧視相關制度,也有制定相關規定。

The Law of United States emphasizes fair employment, or Equal Employment Opportunity. Therefore, employment equality only manifests its nature when the career is open to the talents. The benefit of equality of opportunity is that individuals have the opportunity to obtain positive social mobility. The anti-gender employment discrimination system regulated under the Civil Rights Act includes equal pay for equal work, various protection programs related to pregnancy, childcare, and anti-sexual harassment. After the promulgation and implementation of the Labor Contract Law, China's "Women's Rights Protection Law", "Employment Promotion Law", "Female Workers Labor Protection Regulations", and " Prohibited Fields of Female Workers' work" stipulating the prohibition of gender employment discrimination, equal pay for equal work, and Various maternity protection programs related to pregnancy, childcare, special protection systems for gender differences are also formulated.
