美中三大公報與台灣關係法對「台灣問題」之爭議－以中國2003-2015年公開發言為佐證

摘要

中國認為中美兩國國際關係最敏感的問題是「台灣問題」。兩國關係正常化之後，在此問題上屢生爭議，基本上，肇因於中國以美中「三大聯合公報」與美國以「台灣關係法」處理台灣問題不同法理所致。以2003年至2015年近十幾年視之，台灣歷經兩次政黨輪替，中國官方對美台互動行為的公開發言相當頻繁。這些發言的尖銳不僅出自是時中國根據「三大聯合公報」的「一個中國原則」的框限台灣的國際活動空間，也是針對美國藉「台灣關係法」的美台交流與軍售，作出負面的反應。中國藉由「台灣問題」議題的發言與美國針鋒相對，顯見雙方在國際政治舞台的合縱連橫外，勢必各盡法理之所能，各取法理之所需。

In the acknowledgement of People's Republic of China (China), the most sensitive issue in China-US foreign relation has been the ＂Taiwan Issue＂ even though after normalization in 1979. Tracing the major division on ＂Taiwan Issue＂, China strictly relays on China-US 「Three Communiqué」 while U.S. insists on 「Taiwan Relation Act」. So from the view point to the period of 2003～2015, the government of Taiwan had experienced twice ＂party alternation＂, the closer US got along with democratized Taiwan, the more frequently China's open opposite declarations spurred. Not only do such these declarations based on ＂One China Principle＂ from 「Three Communiqué」 intend to constrain the international behaviors of Taiwan, but also strongly reflect the unwilling to see the benefits of US-Taiwan interaction and arms sale based on 「Taiwan Relation Act」. Since the world politic is put weight on Asia-pacific area, Taiwan Issue shall remain to be the nonsmoking fighting scenario of China-US diplomacy.
