近年來在業者努力下,旅展成為旅遊相關產業重要的展覽平台,對於促銷觀光、旅遊及餐旅服務極有貢獻。但旅展也時因為參展廠商提供商品或服務瑕疵致有消費糾紛,臺中市政府為保護消費者,打算修正原有的臺中市消費者保護自治條例,新增訂第32條之2規定,擬課予旅展策展機構把關責任,在參展廠商未協助改善商品或服務時,對策展機構裁罰。該草案立意雖佳,但考慮未盡周詳,將對觀光旅遊產業及策展單位產生重大影響,並紊亂現有的管理機制上各機關及瑝事人應有的責任。本研究擬從法制、公共行政及旅遊業管理等面向分析,並提供具體建議,期能導正該修法方向,並呼籲官方及民間在釐清相關責任之餘,能共同精進旅展,兼顧旅遊業者及消費者權益保護。
In recent years, travel fair has become an important exhibition platform for tourism-related industries, plays a contribute pole to the tourism industry. Sometimes, there are some products or services defects of exhibitors in the travel fair make consumer dispute. In order to protect consumers' rights, Taichung City Government intends to amend the existing Self-Government Ordinances of Consumer Protection, the new set Article 32-2, propose to impose on Travel Fair curatorial agency the responsibility of checking exhibitors documents and helping to improve the goods or services. If the agency does not obey the ordinance, the agency will face penalty. That move will shed shadow on tourism industry and curators, and disorders the responsibility of the authorities concerned. This study uses the law, public administration and tourism management perspectives to investigate and analysis the problems of this policy and regulations, and provides specific recommendations on amending the law. It is hoped that this study can lead the policy to the right and positive direction, and will help both tourism industry and consumer protection.
