無管委會公寓大廈消防安全設備改善實務研究

各縣市政府消防局面對未成立管理委員會之公寓大廈，常發現其消防安全設備不符合規定，卻因無管委會而無法開具有效力之通知單，並且無法針對各個住戶執行裁處等階段。若要有效開具相關通知單，並進入裁處階段，又需花費大批消防人力逐戶開立，在實務上又常遇到投資戶、無人居住等情形發生而無法取得各住戶資料，致使各無管委會之公寓大廈各住戶之管理權人，縱使有部分住戶想要維修其消防安全設備，卻因部分住戶無法聯繫或是不願花錢而無法維修。若要由該少數住戶進行維修，遇到發電機、消防幫浦、立管等維修費昂貴者，便又打消念頭或無法負擔了。因此，在消防機關無法有效執行裁處之情況下，加上各住戶間之意願問題，日積月累，建物之消防安全設備年久失修，恐已失去任何防護功能，影響公共安全甚鉅，情形堪憂。相對於依規定守法申報維修場所不但不公，也造成公共安全之隱憂，便形成了現在各縣市消防機關之燙手山竽，更是對執行檢查人員、消防搶救人員造成心理上之壓力等問題。在消防署每月更新之重大不合格場所，各縣市亦提報許多是類場所。為能有效提供各縣市目前所遇到的類似問題，如何執行違反消防法案件並進入裁處、行政執行等，以達到有效改善，保障消防人員火災搶救時，該建築物供消防搶救必要設施堪用，並避免發生火災時造成人民生命、財產之重大損失，本文以各縣市之做法及成功之案例，做出相關之研究及比較，希望能協助各縣市改善這些未成立管委會且其消防設備不合規定之公寓大廈。

The Ministry of the Interior provided the National Fire Department with a directive to inspect all fire equipment and provide a written report on their findings. Interestingly, in Taiwan the fire accident rates have continued to decrease. This could indicate that the current system does provide adequate protection and works extremely well. In recent years the government has taken safety management more seriously and has directed more attention on making improvements to the system. While the government has become dedicated to improving the system there are still problems with executing ordinances and implementing other changes to the current system. Since condominiums do not fall under the National Fire Department's control this has created several problems that makes management even more difficult. Condominiums have become the main type of residence in Taiwan. Most are crowded, which makes it hard to escape and harder to make emergency rescues; condominiums can also conceal additional dangers. When the fire department asks the condominium to inspect its fire equipment, it is often difficult to achieve and making them keeping their equipment in good repair has been hard to enforce. Fines are usually ineffective; especially when a condominium does not have any type of established management. Many cities and counties in Taiwan still cannot find an effective solution to the problem, but Chiayi has been successful in several cases. By comparing Chiayi's methods with those that are used in other cities may assist with determining which methods are more effective and why Chiayi has been successful in so many cases.
