國際組織的迅速成長是20世紀的一個顯著特徵。通常,這些組織任用各種類別的職員來實現其工作目標。隨著國際組織活動的擴張以及組織分支的增多,爲其提供服務的國際公務員人數迅速增加,作用亦更爲重要。這些發展帶來的結果是,需要建立某種組織內部的法律秩序來規範國際組織秘書機構中産生的任用關係-在這一法律秩序中,國際行政法庭居於核心地位。作爲一種特殊類型的國際司法機構,國際行政法庭有許多獨特的司法實踐活動。近年來,隨著這些實踐的不斷積累,它們對於現代國際法的多方面影響也開始逐漸顯現。在這些實踐的觸動下,國際法淵源、國際法主體、國際法國內法關係等基本理論問題的研究開始出現一些微妙的變化。本文就此作若干討論,期使學界同仁能夠關注有關的發展。
It is well known that the striking feature of the international organizations in the 21st century is their rapid expansion and diversity. Usually different kinds of staffs are employed to achieve the goals of these organizations. In recent years the number of human agents working for these international organizations has vastly increased accordingly. Today the international civil servant has become an increasingly ubiquitous and active figure on the international stage. As a result, employment relationships in international secretariats call for regulation and control. To establish those orders, certain interior legal system governing employment relations becomes a sine qua non, and administrative tribunals play a key role in maintaining the order.As a special international judicial organ, administrative tribunals of international organizations have their unique practices and have become a greater influence on the modern international law in recent years. Thanks to the promoting, the views on basic theory of international law, such as the theory of source of International law, the subject practice and the doctrine of the relation of municipal law and international law, are changing delicately. Here this article aims to look into the change of theory, hoping to arouse closer attention in the legal circles.
