淺論WTO協定與爭端解決體系對內國法之影響

世界貿易組織（WTO）建立了《爭端解決規則與程序瞭解書》（DSU）規則導向的爭端解決體系，而有助於強化其規範暨爭端解決機構（DSB）裁決之遵守及履行，並能有效解決爭端。然而，DSB之裁決效力對於系爭會員之影響為何，又是否及於非系爭會員？為WTO會員遵守DSB裁決之前提。質言之，WTO爭端解決體系對於內國法之影響為何？是為本文之研究目的。本文擬先以歷史研究法介紹WTO爭端解決體系的組織與功能，以瞭解其要旨、特色與效力。其後，再進一步以文獻探討法分為研究DSB裁決或報告書對於系爭當事會員之拘束力、以及對於非當事會員之拘束性，並加以分析之。最後，在國際法規範經轉換而為內國法適用之圭臬下，探討WTO爭端解決體系對於內國法之影響，而認為無論是否為貿易爭端系爭會員，皆應遵守DSB裁決或報告書之決定而制定或修正相關的內國法規，以期符合WTO所欲建立的自由貿易規範體制。

The World Trade Organization (WTO) has established a rule-oriented dispute settlement mechanism under the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU). Furthermore, not only does DSU reinforce the implement and enforcement of the WTO rules and the awards of Dispute Settlement Body (DSB), it also settles the disputes between WTO Members effectively. Nevertheless, there is a doubt about whether the decisions of DSB can bind non-disputing parties as well as disputing parties or not. Therefore, the purpose of the thesis is to find out the answer about the effects of DSB decisions on domestic legal system by examining the dispute settlement mechanism of WTO.Firstly, with regards to the introduction of the dispute settlement mechanism of WTO, this thesis describes organization and function of DSB by using the Methodology of Historical Research in order to realize the aim, specific regulations, and efficacy of DSU. Secondly, by using the Methodology of Literature Review, this thesis researches and analyzes the binding force or binding nature to disputing party or non-disputing party respectively. Thirdly, this thesis discusses the impacts of WTO dispute settlement system on the internal legal regime following the principle of International Law. By way of conclusion, it is pointed out in this thesis that all Members of WTO are obligated to obey either the awards or the reports of DSB, even if the members have to draw up or revise their domestic laws.
