從數字看新北市勞資爭議概況

A survey of labor disputes in new Taipei from the figures

摘要


隨著工商業日益發達,社會上勞工權利意識逐步抬頭,勞資間發生爭議頻率增加,爭議處理也漸趨複雜化。我國為處理勞資爭議(labor dispute or industrial dispute),保障勞工權益,穩定勞動關係,爰制定「勞資爭議處理法」,作為規範現行爭議處理和穩定勞動關係的重要依據。當勞資爭議發生時,若勞資雙方無法自行獲得和解,可藉由法定程序調查實際情形,適當解決爭端,消弭彼此對立的情況,以保障雙方應有的權利。新北市幅員遼闊,擁有200萬勞工,致104年全年受理勞資爭議案件達4千餘件,因此,本文蒐集六都勞資爭議相關資料,分析近年勞資爭議及其處理情形之變化,以供市府研擬相關政策之參據。

The increasing development of industry and commerce, the consciousness of labor rights in the society is gradually rising, the frequency of disputes between employers and employees has increased, and the dispute treatment has become more complicated. In order to deal with Labor disputes (labor dispute or industrial dispute), safeguard labor rights and interests, stabilize labor relations, and. Formulate "labor dispute treatment Law", as an important basis for standardizing the current disputes and stabilizing the working relationship. When labors disputes occur, if the employers and employees cannot obtain conciliation by themselves, they can investigate the actual situation through statutory procedures, resolve disputes properly and eliminate opposing situations so as to protect the rights of both parties. The New Taipei City has a vast territory, with 2 million labors, and 104 years of labor-related dispute cases to more than 4,000, therefore, this article collects labor disputes relevant data, analysis of recent years, labor disputes and the changes in the treatment situation, for the municipal government to develop relevant policy reference.
