智慧財產權法於大學通識教育課程之教學實踐-以美國案例式全英語授課為中心

摘要


二十一世紀之通識教育於高等教育因應科技快速發展、經濟持續增長之挑戰下,成為培育現代公民相當關鍵之指標,而智慧財產權相關知識之認識與思考,更是身為大學生之知識分子深切體認並實踐之現代公民核心能力之一。我國行政院國家發展委員會規劃自2018年起啟動「雙語國家政策發展藍圖」冀盼以2030年為目標,成功打造臺灣成為雙語國家,而教育部進一步訂定以「培養臺灣走向世界的雙語人才」、「全面啟動教育體系的雙語活化」之目標落實於大專院校教學實踐計畫。職是之故,於全英語授課環境下,如何將《智慧財產權法》導引於通識教育核心理念,透過美國案例式課程方式呈現,將《專利法》、《商標法》、《著作權法》與《營業秘密法》等相關知識從法律角度使學生有所收穫與成長,實為通識教育教學實踐中一項重要之課題。

With the rapidly development of science and technology as well as the increasingly growth of economy in the 21 century, general education under the global higher education system has becoming a key indicator and a more and more important character to engage for cultivating modern civics seeing that a striving challenge by means of the clear understanding of intellectual property rights. National Development Council under the Taiwan Executive Yuan proposed the "Blueprint for Developing Taiwan into a Bilingual Nation by 2030" from 2018, scheduling Taiwan to become a bilingual Nation by 2030. Accordingly, the Ministry of Education further proposed "Cultivating Taiwanese Bilingual Talents into the World", "Activating Completely Bilingual Education System" to be implemented in the teaching practice research program among Taiwanese university and colleges. As a result, by teaching in English, how to introduce "intellectual property laws" to the core concepts of general education, and to perform critical thinking through the American case-based curriculum, which combines the "patent law", "trademark law", "copyright law", "trade secrets law" and other related knowledge allowing students to gain and grow from the legal perspective, would be an imperative matter for the teaching practice and research under the general education.
