初探「我國」大專院校學生兼任助理勞動權益問題

The University Study of labor rights for students as adjunct assistant in Taiwan

摘要


「我國」近年來對大專院校學生兼任助理,經教育部於103年度協請調查現有169所大專院校有134萬人,其中23萬人兼任助理工作,包含論文研究、圖書館工作、行政工作、教學助理、研究助理等,對中央勞工及教育主管機關與學校學生間,產生不同認知上的爭議,衍生相關勞動契約、勞動條件、學習與勞動型態認定、勻支費用等各種問題,是否屬於勞動契約要件,乃為本文研究課題。依據「我國」憲法第153條保護勞工之法律,制訂勞動基準法勞動條件最低標準,保障勞工權益,加強勞雇關係,促進經濟發展,凡適用該法之行業或工作者,雇主與勞工所訂勞動條件,不得低於該法所定之最低標準;故本文探討學生兼任助理應否認定為實質提供勞務工作,得否主張勞動權益,有否影響各項給付權利義務。本文嘗試朝學生兼任助理勞動權益等問題面向,針對學校僱用兼任助理處理作為是否妥當,對符合勞動基準法之認定基準,應如何解決當前面臨勞雇關係基本要件,宜應否專法訂定勞雇間勞動契約之工時、工資、工作性質、從屬關係範圍等勞動條件,經研究發現一些法令與實務上問題,冀希提供化解當前各方困窘議題與意見,做為建議行政機關、學校及學生三方均能達到三贏目標。

In recent years, though the Ministry of Education survey, we have 1.34 million students in our 169 universities, which 230,000 students are adjunct assistant. Their work include contains papers research, library work, administrative work, teaching assistant, and research assistans, etc. Between the central labor and the education authority and school students, different cognitive arouse controversy in related labor contract, working conditions, learning and labor styles found, uniform support costs and such on issues to research whether belongs to labor contract elements is this study subject. According to the Constitution 153th article to protect labor rights, Labor Standards Act is enacted in the hope of regulating the minimum standards of labor conditions, securing labor rights, strengthening employer-employee relations, and facilitating social and economic development. Any industry or workers who apply the law, made the labor conditions by employers and workers, shall not below the standard by the law set. This paper discusses whether students serve as adjunct assistant should be denied the substantive labor be accorded labor rights guarantees and effect the payment right obligations. This paper attempts to study the labor rights of students as adjunct assistant and so on, aimed at the process of schools hiring adjunct assistant is appropriateness or not, for how to solve the basic elements between employer and workers or should be designed specific law to made the labor conditions for labor contract of work, wage, and work style, and the relationship range. By the study to find some questions on the law and practice, we hope to provide the suggestions to resolve current embarrassing issues, and views of the parties in order to the Administration, schools and students can reach three winning goal.
