摘要

知識產權政策的功能在維護知識權利的正義秩序和實現知識進步的效益目標。知識產權政策係根據社會發展需要，對於哪些知識賦予知識產權，並且以何種方式保護知識產權，做出正確選擇和安排。本文採文獻研究法，從政策變遷角度解讀近年來中國大陸知識產權政策變遷的過程，並以Kingdon｢政策窗｣（policy window）的理論闡釋知識產權的司法保護過程，其對實務有指導和啟發作用。筆者建議：加強部門溝通，完善知識產權保護政策和補足科研評價指標，俾推動中國大陸知識產權政策朝著更加創新、更加完備、更加科學的方向發展。

The function of intellectual property policy is to maintain the justice order of knowledge rights and realize the benefit goal of knowledge progress. Intellectual property policy is based on the needs of social development, making correct choices and arrangements for which knowledge is endowed with intellectual property rights and how to protect intellectual property rights. This article adopts the literature research method to interpret the process of intellectual property policy changes in mainland China in recent years from the perspective of policy changes, and uses Kingdon's theory of "policy window" to explain the judicial protection process of intellectual property rights, which has guidance and inspiration for practice effect. The author suggests: strengthening interdepartmental communication, improving intellectual property protection policies, and complementing scientific research evaluation indicators, so as to promote the development of mainland China's intellectual property policies in a more innovative, more complete, and more scientific direction.
