摘要 過去人口販賣問題,僅存於一國之內,近年來,由於全球化的趨勢,國際無界限的網路交通,促使國與國之間往來互動頻繁,人口販運已演變爲跨國性、世界性組織犯罪型態,活躍於國際之間,形成堅固的犯罪結構體。跨國性人口販運的日趨嚴重,除涉及內國與國際間政治、經濟、社會問題外,就法規範而言,更對內國法與國際法以及人權公約的法律適用造成重大的衝擊與挑戰。本文係就跨國性人口販運有關性剝削部分,美國與我國在立法政策,以及法官判決所考量的因素與刑度加以探討,透過對兩國判決內容的比較分析,能夠進一步了解人口販運的犯罪情狀,在兩國法律的適用上有何異同?法院判決將對社會造成何種影響?以及跨國性組織犯罪是否應循更妥適的途逕予以解決?這三大問題進行研究。
Abstract The problem of trafficking in human beings existed only among the inner country in the past. With the trend of globalization and the international non-boundary transport network facilitated in recent years﹐human trafficking has evolved as a transnational organized crime patterns and become a strong criminal structure. Transnational trafficking in human beings turns out to be much severe now and also involves international politics﹐economic affairs﹐social issues as well as law norms. As a consequence, transnational human trafficking results in a major impact on internal law and human rights conventions. This paper accentuates sexcual exploitation of transnational human trafficking﹐especially focusing on the correlated public policy and judicial precedents in Taiwan and the United States. This paper expects to achieve three objects through the comparative analysis. First, the convergence and divergence of their human trafficking structures, including the application of laws between Taiwan and the U.S. Second, it is necessary to realize the social implications of court judgements about transnational human trafficking. Last but not least, this paper also tries to figure out if there is a more effective way to combat transnational human trafficking.
