When occupational injury happens, worker accident victims usually received various damage, e.g., life-threatening, physical, mental and assets damage. Taiwan adopts trio system of workers’ compensation systems — the compensation for occupational accidents under Labor Standards Act, the payment for occupational accidents under Labor Insurance Act, and the indemnity for infringement under Civil Code. However, the amount of workers’ accident compensation is deducted from the amount of compensation claimed by Labor Standards Act 59 and the Labor Standards Act 60. How to conduct deduction between Acts and Civil Code in practical operation is still not clear. The current study summarized judicial decisions in practice, analyzed the current possible issues, and proposed suggestions to solve them.
