整合發明與設計專利資訊之指標於企業專利運用策略之探討

摘要

近年來，各企業間專利戰如火如荼的展開，較具代表性的專利戰為被稱世紀之戰的蘋果與三星在美國加州專利權訴訟之案，最終結果為三星敗訴，其侵犯的專利內容不僅包括技術方面的發明專利，還包含外觀的設計專利。由此可知，企業對於智慧財產權的重視已不再只是技術方面的發明專利，對於設計專利也越來越重視。本研究將設計專利與發明專利一同探討，使企業可同時了解自身在某領域之設計與發明專利之定位，並採行適當的專利運用策略。本研究整合三項專利指標，分別為專利活動指標(PA)、發明專利品質評價指標(UPQe)和設計專利品質評價指標(DPQe)所構成，專利活動指標的高低，代表企業在特定領域中投入資源的多寡；專利數量多，並不代表專利品質好，故利用運算專利品質評價指標來判定，若評價高，代表一間企業所擁有的專利品質較好。透過一系列的運算，瞭解各企業在特定領域中之設計及發明之專利數量和品質，進一步建立三維專利矩陣，掌握各企業在特定領域之定位並依其定位建議未來可實行之專利策略。本研究利用鋰電池以及手機兩個案說明如何建構此矩陣以及給予企業適當之策略建議。

In recent years, patents are widely used by many companies as a weapon against their competitors to gain strategic advantages. The most representative patent law case is the Samsung v. Apple. Samsung Co. finally lost in its patent war and the key reason is its infringement of a design patent owned by Apple Co. Invention, design and utility model can be protected through patent. Those are inherently different and design patent enlightens its importance from this patent war and needs new perspective from traditional patent analysis. This research identifies some unique attributes of design patent and proposes new index method to incorporate both utility and design patents to assist the company in positioning and selecting better patent utilization strategy. In addition to traditional patent activity index (PA) for the quantity perspective of patents, two new indexes to evaluate the utility patents quality (UPQe) and design patent quality (DPQe) are introduced in the study to survey their respective patent quality. Forming these indexes as a three-dimensional location plot, one can evaluate more clearly the strength of a company through its investment in patents and to what degree of quality in both invention as well as design capability. Also the location plot can relate to a suitable patent utilization strategy. Both lithium battery and mobile phone cases are used to demonstrate the usage of this integrated index method and to show how to select suitable patent utilization strategy.
