所謂「政府資源有限,民間力量無窮」,因為辦理區段徵收後可建地標脫不易,常使政府陷入龐大的資金困境,公私合夥就演變成土地開發的新趨勢,雖受限於法令規定,私部門僅能以行政輔助人之角色參與,然國內公私合夥區段徵收模式卻已有實際案例。因此,引發該模式執行的可行性、公平性的維持及建構一個可行模式的探討。 本研究透過文獻理論之蒐集、我國區段徵收模式及案例的整理分析之後,共歸納出四項研究課題。為因應該四項課題,本研究採用專家問卷及訪談法,去深入瞭解具實際執行公私合夥區段徵收案經驗之公、私、地主等人員的風險態度、參與感受及改進建議,再運用成對比較法進行開發風險的評量,以及透過開放式問卷的整理與歸納,去形成本開發模式的執行策略。 綜上,本研究共提出下列四項成果與發現: 一、公私合夥區段徵收模式,是一個有效且符合公平的土地開發模式,且提供我國大規模土地重新分合整理(即Land Readjustment)計畫一個新的執行方式。 二、建構公私合夥區段徵收模式之執行流程,提供未來公、私部門辦理區段徵收之參考。 三、提出公私合夥區段徵收開發模式中,各部門可能面對的風險因子,及相對應之規避策略建議。 四、提出實務執行公私合夥區段徵收案時,其辦理之考量及策略建議。 另外,本研究基於成果及發現,亦提出下列四項建議: 一、公私部門可建立一個溝通平台,明確劃分雙方權責,以有效減低開發案操作及政策改變的風險。 二、公私雙方以契約建立合作關係,可在契約規範上,建立更具彈性的作法。 三、建議私部門可因應地區民情與習慣,積極投入地方活動,適度給予回饋與居民建立情誼,以促使開發案推動更為順利。 四、鼓勵私部門推動地方回饋或友善計畫,因應協商、諮詢等交易成本的增加,建議可考量建立「開發總成本」的觀念。
As the saying goes “government has limited resources but the private sector has limitless power,” it is hard for the government to sell built-up area after zone expropriation, so the result of zone expropriation usually causes the financial difficulties. In a consequence, the public private partnership mechanism becomes the new tendency for proceeding land developments. Although the private department plays the administrative roleunder(行政輔助人) the limitation of laws, the public-private partnership mechanism in zone expropriation already has the practical cases in Taiwan. Thus, this mode should be feasibility and fairness of the maintenance, and be constructed a discussion of a feasible study. After gathering and analyzing the related literature on the domestic zone expropriation’s modes and cases, four issues are found. According to the four subjects, this study uses two tools, expert’s questionnaires and interviews, to examine the public department, private department, and landlord’s risk attitude, impressibility and improvement when the government adopts the public-private partnership mechanism in zone expropriation. Then, this study uses the pairwise comparison to evaluate the land development’s risk, and the analysis of open-ended questionnaire format to construct policy strategies of the public-private partnership mechanism in zone expropriation. As described above, this study proposes four contributions: 1. The public-private partnership mechanism in zone expropriation is an efficacious and fair land development mode, and provides a new method for domestic large-scale land readjustment plan. 2. To establish a procedure of public-private partnership mechanism in zone expropriation in order to give public and private departments the helpful references for dealing with the public department to proceeding zone expropriation in the future. 3. Every department may face the risk factors and corresponding suggestions of hedging strategies’ as the government adopts the public-private partnership mechanism in zone expropriation. 4. When the government adopts the public-private partnership mechanism in zone expropriation, the issues and strategies should be considered. Moreover, through this study’s conclusion and achievements, it also can contribute four recommendations as the following: 1. The public and private departments can establish a communication system to identify the responsibility between them in order to reduce the operation of cases and the policy’s changing risk. 2. The public and private departments were under contract to establish cooperation relationship which creates a flexible method. 3. According to regional sentiments and customs, we can suggest the private department advocates the suitable feedback and friendships with local residents in order to promote the development cases’ proceeding. 4. Encouraging the private department promotes the local feedback or friendly plan. Due to the negotiation and consultation’s increasing cost, the concept of “Total Cost of Development” should be considered.
