摘要

本論文以理論角度切入我國少年事件處理法，以實際案例探求少年事件處理法第1條健全自我成長權之內涵。問題意識為釐清社會遂行義務的核心理念。在章節安排上，第一章會以一個實際案例為中心。第二章，以犯罪學中危機樹理論，談論社會義務的存在。第三章談論當如買姓少年進入我國少年事件司法系統後，當時發生了什麼事，分別是制度介紹與可討論之重點。第四章以兒童權利基礎理論出發，以兒童權利公約尋找少年司法系統的核心思想，即社會遂行義務之目標；並進行檢討。第五章總結前論，提出願景。

This thesis starts on basic theory of children’s rights, in order to seek the concept of Act 1 of Juvenile Delinquency Act In Taiwan. The main issue is what’s the main idea of social responsibility. Study method is eclectic approach. In chapter 1, will be centered on an actual case. The second chapter use criminology theory to talk about the existence of social obligations. Chapter 3 introducing the juvenile justice system, and the points may be focus to discussion. Chapter 4 starts on basic theory of children's rights, in order to find the core idea of juvenile justice system in CRC, namely the obligation of society ,our final goal, and review it. The last chapter summarizes all of the above and put forward a vision.
