文化資產保存法立法的目的,是在於保存這塊土地上面人類生活所留下來的歷史軌跡,考古遺址就是那編織歷史的軌跡。然而在南投縣十年的考古遺址監管保護工作,考古遺址卻屢遭防護疏漏的毀壞。 本研究透過南投縣考古遺址監管保護工作的施行結果,嘗試釐清考古遺址屢遭大規模破壞的憾事緣由;初步從實況歸納得幾個層面的影響與原因:縣府各平行單位未建立連線機制,致遺址無法在申請建造時即能得到防護;監管工作團隊未完整執行通報工作、怠職所致;主管機關對於大規模農墾行為耽延、消極處置等為主要影響因由。但追究根由,乃因存在著法規未周全的問題,因此影響主管機關的處置態度,致使所有工作環節與工作結果屢屢出現漏洞。 考古遺址有著埋藏性內涵的屬性,因此之故,每一處考古遺址都存在著未知的潛藏價值,從考古遺址已知的價值為立法的標準;是侷限、也是對考古遺址歧誤的認識。
The enactment of the Cultural Heritage Preservation Act is to preserve Taiwan's historical and cultural heritage. Archaeological sites are the yarns that weave our past. However, the preservation and monitoring of the archaeological sites in Nantou County have not been successful in the last decade. The omission of protection leads to the unrecoverable destruction of the sites. My study explores the reasons for the repeated large-scale destruction of the archaeological sites in Nantou County through the results and experiences of several monitoring and preservation projects in the county. This research concludes the following reasons from several aspects of practical observation: a) the lack of horizontal communication mechanism between the administrative units in the county government resulting in the site not being protected when applying for construction permit; b) the consignees of the monitoring project failed to fulfill their responsibility for notifying the county government; c) the occasional passive attitude of the administration when dealing with the large-scale agricultural activities on archaeological sites. However, the unstable legal foundation is the primary fact that affects the attitude of the administrative authorities; hence, loopholes appeared repeatedly in all the work sequences and project results. Archaeological sites are usually invisible on the ground due to their buried nature. Each archaeological site contains its own part of our past of this island; hence each archaeological site has its own unique and hidden value. Protecting those well-known archaeological sites is not enough and may lead to unrecoverable consequences to other unknown and undiscovered archaeological sites.
