從兩性平權觀念探討婦女人權之實際-以兩性工作平等法為例

摘要


本文旨在探討從「兩性平權」觀念,包括相關之「兩性平等」、「兩性平等教育」、「婦女人權」、「兩性工作平等」等不同之角度,進行探討、分析,以瞭解「兩性平權」與「婦女人權」之發展,對婦女權益之影響,進而就「兩性工作平等法」為例,進一步探討該法之條文內容中,對「兩性工作平等」與「婦女工作權益保障」有否更明確、更完善,同時政府與企業界對性別歧視防患措施之因應如何,分別以行政院主計處與勞委會統計處等人力運用調查報告資料列出有關為落實「兩性工作平等法」之施行成效,特別將近三年來婦女勞動條件概況、工作上是否有性別差別待遇,婦女接受訓練情形、工作職場上是否有反性騷擾、產假、陪產假之規定、需要政府協助之處,婦女留職停薪、托兒設施之提供等各項狀況之調查統計資料,加以探討分析,以瞭解目前台灣婦女工作權益獲得之程度。文中並舉出一些專家學者對推動兩性平等教育與為落實兩性工作平等主張應與產業民主相互配合以及如何建立兩性平等之工作環境,均有較為妥善之建議,以供政府、企業界、受僱員工們大家共同之參政,使我國「兩性工作平等法」對婦女在就業、工作上之權益,均能獲得較完善的保障。

This thesis is aimed to explore the campaign of “equal rights for both men and women”. Relevant issues, including “equity between both sexes”, “education on gender equity”, “human rights for women” and “equal rights to work for both sexes”, have been explored and analyzed to find out about the impact brought about by the campaigns of “equal rights for both men and women” and “human rights for women” upon development of women’s rights. In addition, “The Gender Equality in Employment Law” has been examined to determine whether both sexes enjoy equal access to the job market and women’s right to work is assured. In the meantime, research has been done on the measures adopted by the public and private sectors to prevent sexual discrimination at the workplace. In order to realize how “The Gender Equality in Employment Law” has been implemented, human resource reports published by the Directorate General of Budget, Accounting and Statistics, as well as Council of Labor Affairs, Executive Yuan have been cited. These reports provide insights into women’s conditions at the workplace over the past three years—the overview of treatments received by career women, the status of gender equity, vocational training for women, institution of regulations against sexual harassment, availabilities of parental leave, assistance from the government, positions preserved during maternal leave, and daycare facilities, etc. Reports and statistics regarding the above issues have been analyzed in the thesis to find out how well women’s right to work is protected in Taiwan. Experts’ advice is available in the thesis for the government, industry, and the workforce as a whole to help implement education programs on gender equity and assure the working environment is equally favorable for both sexes. It is hoped that “The Gender Equality in Employment Law” can live up to its promise to protect women’s rights to work and at the workplace.
