肇事賠償對車輛評價損失計算模式之建立

當道路發生交通事故常會造成人員傷亡與財物損失，在法律上雖然已有民事損害賠償之詳盡規範與訴訟程序可以協助，惟肇事雙方當事人在事故賠償的過程中，往往對於賠償金額有主觀認定上的不同，導致肇事方所願付出的賠償金額與被害方所願接受的賠償金額存在著差距。目前在國內有很多的事故糾紛急待解決，迫切的需要建立一套客觀、合理的事故賠償估算方法與參考金額以為依循，是本論文主旨所在。首先針對中古車車況與其實際成交之交易價格進行蒐集與分析，以量化研究方式進行統計分析，期以分析出市場實際之交易面，對於車輛損傷修復後之車體評價損失的隱形計價，建立出一套車體事故對車體評價損失計價模組【(Y2)= 174487.791+26149.262 (X2)】，作為車輛事故雙方當事人進行車損民事求償金額之參考依據，並提供司法機關審理時之參考。

Road accident has always resulted loss/damage of property, personal belonging and human dead or injuries. Although compensation cases can be resolved by civil law, but in the process of demanding compensation, both parties will always dispute in amount of compensation. This has causes compensation gap between both parties. There are lots of accident dispute cases pending and need to resolve. There is an urgent need to build a set of objective, reasonable accident compensation calculation and scheme. This research firstly focus on collecting and analyzing the used vehicles conditions against the actual transacted price, using quantitative research method performing statistical analysis and hope to analyze out the actual market trading surface. Regarding of the invisible accident vehicles value after the vehicle repairs after accident, a set of vehicle body condition assessment and vehicles valuation after accident structure need to be developd【(Y2)= 174487.791+26149.262 (X2)】. This assessment and valuation structure can be used as a basis for both parties and legal authorities during accident compensation legal proceeding.
