行政院組織改造的理論與實務－ 從「政策窗」模型看行政院組織法變革過程（1991~ 2006）

摘要

本研究係採取「歷史與法制」研究途徑，藉由「文獻檢視」、「次級資料分析」與「比較分析」等研究方法，以John W. Kingdon的「政策窗」模型為藍本所發展的研究架構，針對民國八十~九十五年 （1991~ 2006）間、政黨輪替前後，行政院組織改造相關的歷史演變加以檢視分析，並從法制面著手，以「行政院組織法修正案」（以下簡稱「組織法草案」）為研究客體，對其研議過程及內容進行探討。

經由上述的檢視過程，本研究試圖從「問題」、「政策」、「政治」、「議程」四個面向，分析行政院組織法修正之過程與結構性因素，設法找出在政黨輪替前後行政院組織法修正過程當中，何者可能是啟動修法活動的「改革契機」（「政策窗」）以及其以何種形式呈現，並進一步探究政黨輪替前後政府行政院組織法修正方案及作為間之異同及關聯性，檢視「行政院組織法修正案」由行政部門（政府議程）進入立法院修法議程（決策議程）的合法化運作過程，最後再透過上述四大面向的綜合分析，嘗試對「行政院組織法未能如期順利完成修法」的核心研究問題進行綜合診斷並提出對治建議。

透過「問題」、「政策」、「政治」及「議程」等四大面向的綜合分析，本研究認為「行政院組織法修正草案」未能「順利如期完成修法」之病端，主要發生在「政治」及「議程」的部份； 而針對問題病灶，本研究亦分別就政治及議程面，提出對治的解套建議，並進一步針對立法部門決策議程當中，導致各黨團僵持不下之草案爭執點，提出本研究之看法，以供修法者取捨參考。

In view of the reorganization of the Executive Yuan in A.D. 1991~ 2006 around the Political Alternation, this research adopts the “history and legislation ”approach, and proceeds with the “literature inspection”, “the secondary material analysis” and “the comparative analysis” methods to exam the related history, legislation system, amending process and the canvass in the executive department and parliament.

The construction of this research is based on the “Policy Window” model which created by Dr. John W. Kingdon who’s the famous owner of Aaron Wildavsky prize in 1994.

As the object which “the Amending Bill of Executive Yuan Constitution Law” is, this research intends to discuss the core issue of “Why the amending procedure of the Executive Yuan Constitution Law always being interrupted and never succeed as anticipation?” and attempts to figure out the reasons and causalities.

Through the integrated inspection from the “subjection”, “policy”, “politics”, and “agenda” angles, this research confirms which the “Window of Chance” is within the ruling period of KMT. or DPP. Regime, then figures that the interruption and delay of the amending procedure is caused by the problems in the “politics” and “agenda” angles, and provides the solving suggestions in the end.
