我國電信詐欺預防政策執行人員意向與影響因素之研究

摘要


我國雖已致力於電信詐欺防制政策執行多年,然政府機關於執行政策時,也常發生執行不力的情形。我國電信詐欺犯罪的氾濫,起源於犯罪工具﹙人頭帳戶、人頭電信卡﹚過於容易取得,導致詐欺犯罪未能得到有效控制,而這樣的問題關鍵與第一線執行人員有無嚴格審核、把關有高度相關。鑑此,本研究欲探討電信詐欺預防政策執行過程中所產生的問題與困境,及在政策執行過程間可能的因素,使政策執行人員執行意向產生影響,並據此提出相關政策建議。 本研究係從「政策執行」的觀點切入,並採用「文獻分析法」及「深度訪談法」,透過廣泛蒐集國內外相關文獻及我國官方相關數據資料等,以有系統的分類、整合與歸納,獲得研究主題相關資訊,以為本研究基礎,作為訪談工作的前置作業及確定我國電信詐欺犯罪預防政策現況,探討現行政策執行上出現的問題,並針對可能影響政策執行人員意向的相關因素:政策的認知、方向、強度、誘因等四大面向去探討對於執行人員意向的影響。 經深度訪談實際從事電信詐欺預防政策之執行人員實施深度訪談,研究發現結論如下: 一、在政策認知面:相關執行人員對於政策執行角色的認知是以警政機關為核心,電信、金融部門對於電信詐欺預防政策缺乏整體認知。 二、在政策方向與強度面:多數受訪者均支持現行政策。 三、在誘因面:執行人員詐欺預防的努力所受獎勵不足,卻易受懲罰。 四、影響因素:企業社會責任的重視與否、執行人員本身的素質等均會影響到整體詐欺預防政策執行的成效。 基於上述研究成果,本研究針對「政策認知」、「政策方向與強度」、「誘因」、「影響因素」等四大方向提出相關政策建議,以強化電信詐欺預防政策執行成效,俾供未來政策改進之參考。

Although the R.O.C. government had devoted in preventive policies for telecommunication fraud for several years, there were usually situation of poor enforcement. The flooding of crime committed telecommunication fraud is due to obtaining of instruments (dummy account and sim card) of crime is too easy, which leads to ineffective control of telecommunication fraud crime, and these critical problems are highly related to strict review and control carried out by implementer at the first stage. Thus, this study aims at analysis of problems and dilemma generated during implementation of such policy as well as essential factors affecting intentions of implementers, nevertheless, to provide policy recommendations related to this subject. This study is carried out from the view of “Policy Implementation” with the approaches of “Literature Analysis” and “Deep Interview” to collect relevant documentations and official database inside and outside the country, through systematic categorize, integration and induction to retain information related to this subject. By using this study as a basis, we can prepare pre-interview process and affirm the status quo of preventive policy for telecommunication fraud in R.O.C., and discuss the problems found so far upon existing implementation and the factors which could essentially affect implementers’ intentions such as policy recognition, direction, strength and incentive. After deeply interviewing implementers related to practices of this policy, the conclusions of this study are listed as below: I.Policy Recognition: The relevant staff acknowledged that the core role of implementation is polices agents, and there was lack of integrated recognition of preventive policy for telecommunication fraud in telecommunication and financial sectors. II.Policy Direction and Strength: Most of interviewees supported the existing policy. III.Incentive: The rewards for efforts on fraud prevention carried by implementers are insufficient, but implementers will be punished easily. IV.Affecting Factors: Corporate Social Responsibility and the quality of implementers are all factors which will affect integration effectiveness on fraud prevention policy. This study will propose policy recommendations related to four dimensions such as “Policy Recognition”, “Policy Direction and Strength”, “Incentive” and “Affecting Factors” to enforce implementation effectiveness of prevention policy for telecommunication fraud as well as provide reference for policy improvement in the future.
