警察包庇色情成因與防範

摘要

2009-2011年間，又因爆發警察包庇王媽媽應召站及五木路民生會館之案最為重大，重重打擊警察人員形象，社會莫不以更高之品操標準檢視警察團體，警察人員包庇色情業者至今在全國各地從未斷絕，嚴重傷害警察執法威信，流失民眾對警察執法的信心，故本次研究要從最根本的貪瀆成因，作為研究主題，研究目的如下：
一、於09-11年間包庇色情相關資料抽樣，分析警察包庇色情現況及防範策略。
二、藉由個案及文獻探討資料中分析、研判警察人員可能涉入包庇色情弊案之
相關因素，了解可能影響警察人員涉嫌包庇貪瀆之內、外在因素。
三、經由本次研究發現警察人員包庇色情之影響因素，進而提出可行之預防對策
建議，以供未來決策之參考。
本研究將採深度訪談為主要之研究方法，並以警察人員包庇色情相關文獻資料作為輔助參考，研究對象以2009-2011年間警政署政風室3大警察人員集體包庇色情案件為研究場域，針對當中涉案主嫌之同事及監聽偵辦人員作為訪談對象，進行質性訪談，以蒐集多元的研究資料。
本研究將訪談結果透過犯罪學三大理論〈自我控制理論、差別接觸理論及日常活動理論〉結合其涉案員警其個性及犯罪環境，了解有關可能包庇色情業者之因素，研究發現結果如下：
一、本次涉案之主要員警均為低自我控制之人，因衝動..等心理內在因素促使其
選向違法包庇色情之路，理性選擇其欲得之不法利益。
二、因取締色情專案人員之身分，與色情業者長期相處互相學習及了解對方行業
後，進而互惠互利，進行不法之包庇色情行為。
三、涉案之員警因取締色情專案人員之身分，有較多時間與色情業者相處，又因
缺乏同事、長官或其他有效之監控人在場，因而發生包庇色情業者之情事。
針對本研究發現之事項，建議需針對警察人員心理內在因素、工作外在環境以及執勤督導方式等三方面提出幾項建議，望能針對警察勤務特性安排適當服勤人員，除能勝任勤務外，也可以避免再有包庇色情業者之不法事件發生，因此研究者提出下列建議事項：
一、嚴格考核及訓練警察人員心理特質。
二、建立監督機制，建置警察人員資料庫。
三、加強督導所屬各類專案勤務人員。
四、警察考評機制應增加生活型態的考評紀錄。
五、色情專案人員應避免任用具高危險低自我控制之人員。
六、定期法令宣導，強化法令觀念的一般預防效果。
七、落實警察人員職務輪調制度及強制代理人制度，並建立抽查或複檢制度。
八、強化主管對於所屬人員的監控能力，訓練主管觀察同仁貪污行為的能力。

Between 2009-2011, the outbreak of police cover-up for “wang mama porn station” and “ming-shiung hall” grievously damaged public impression of police, and the whole society became alerted to the moral standard of law enforcement. However, scandals of police cover-up for porn industry keep happening and the department gradually the citizens are losing faith in police discipline. Hence, this research is meant to enquire into the causes of police corruption, and research objectives are as follows:
First, sampling of related data of police cover-up for porn industry between 2009-2011 to analyze the current situation and prevention strategy.
Second, to conclude both internal and external factors that possibly lead to the involvement of police cover-up for porn industry through individual case study and document analysis.
Third, to summarize factors that affect police cover-up for the porn industry, and furthermore to provide feasible suggestions for prevention strategy.
The research adopts interview as main methodology, supported by related documents, to discuss three cases referring to police collectively cover-up for porn industry events during 2009-2011 investigated by Civil Service Ethics Office of National Police Agency. Suspects and detective inspectors involved are focused on as objectives and are interviewed to collect multiple research information.
The results of interviews would be analyzed through three criminal theories: Self-control Theory, Lifestyle Theory and Differential Association Theory, combining individual personality and criminal environment, to understand possible contributory factors. The major contributory factors are cited as follows:
First, policemen involved are tend to have personality of low self-control, and choose to get illegal benefit from cover-up events due to mental factors such as an impulse.
Second, policemen, especially those on the special task of enforcing porn industry, have more chance to deal with porn industry for a long period of time and make acquaintance with unscrupulous dealers, and moreover, gained mutual benefit.
Third, due to the lack of accountability from colleagues and supervisor, it’s easier to gain illegal benefit from cover-up for policemen on the special task of enforcing porn industry.
According to the factors mentioned above, this research suggests three aspects need to be improved: inner mental factor, external working environment, and supervision of execution. In order to arrange proper staff corresponding to the characteristic of police execution and prevent occurrence of cover-up for the porn industry, this research provides following suggestions:
First, carry out strict examination and training for mental quality of police personnel.
Second, establish a supervision mechanism, build a database of police personnel.
Third, intensify the supervision to all types of special-task personnel.
Forth, include personal lifestyle evaluation into police evaluation mechanism.
Fifth, avoid assigning those who are at the risk of low self-control to the special task of enforcing porn industry.
Sixth, enhance juritical conception and hold propaganda of regulation regularly to reach the effect of prevention.
Seventh, implement systems of position switch-over and substitution, and establish sampling and re-exam system.
Eighth, enhance the accountability of the supervisor and train the ability to aware the corruption of the fellow.
