本研究以法務部矯正署北區某監獄2010年度,假釋審查委員會審查假釋報告表作為研究的基礎,分析假釋報告表中的資訊會影響假釋審查委員對准駁假釋的判斷。本研究最後共收集到400個案及其假釋申請表相關訊息。 本研究採用邏輯式迴歸模型,建立受刑人假釋准駁之預測模型,結果顯示假釋審查委員是否核准假釋顯著受「婚姻狀態」與「法務部駁回紀錄」影響,表示已婚狀態的受刑人假釋較容易通過假釋,且前次被法務部駁回者較容易再次通過假審會審查。此外,研究分析結果也顯示顯示法務部的准核受到下列因素的影響,一、本次犯罪年齡越大者,法務部越不容易通過假釋案。二、已婚者較易通過假釋。三、初犯及再犯相對累犯而言,較易通過假釋。四、在監表現中有獎勵紀錄,較易通過假釋。五、執行率越高者,駁回可能性越低。 根據研究結果,本研究建議現行的假釋審查表格中,名籍事項等欄位需要保留,家庭現況等欄位需要重新設計題目或答項,思想與觀念等欄位因不具有效度或填寫困難,建議可刪除。
This research is base on data from the 2010 parole board parole reports of a northern Taiwan prison operated by the Ministry of Justice Agency of Corrections. It analyzes how information contained in the reports influences parole board decisions. A total of 400 reports and related information were used for this research. This research uses logical regression analysis to predict the probability of prisoner parole. The results indicate that whether the parole board grants parole is influenced by the marital status and the Ministry of Justice parole register record of a prisoner. Married prisoners are more readily granted parole as are those who have been denied parole previously. Furthermore, the analysis indicates parole approval by the Ministry of Justice is influenced by several factors. The first one is age. The older prisoners are, the less likely they are to be paroled. The second factor is marriage. Married prisoners are more likely to be paroled. The third factor is number of offenses. First and second time offenders are more likely to be paroled than those with more than two offenses. The fourth factor is prison behavior. Those who have a record of good behavior in prison are more likely to be paroled. The fifth factor is the minimal amount of time that must be served for a crime. The higher it is, the less likely parole will be granted The research results suggest that the name and birthplace of a prisoner should be kept on their parole application form. However, areas on the form pertaining to family status need to be redesigned. Also parts on the form related to the thoughts and ideas of a prisoner are difficult to fill out and do not affect parole board decisions. Thus, they should be eliminated.
