假釋審查決意影響因素-以DEMATEL探究男監女監之差異

摘要

受刑人的假釋准駁與否有賴各監獄假釋審查委員的決意，相關研究已顯示，假釋審查決議受到多重因素之影響。然而，假釋審查委員在決策時，其內在主觀考量構面間之相互影響關係為何，目前仍欠缺探討。本研究將對此進行探究，並針對男監與女監假釋審查委員主觀決意因素差異進行比較。本研究針對三所女監的假釋審查委員進行調查，且選取北、中、南各一間男監的問卷資料與女監結果進行比較。女監問卷回收份數共19份，分別為桃園女監7份、台中女監6份、高雄女監6份。而男監部分，為北部某監獄問卷6份、中部某監獄8份、南部某監獄7份。研究結果顯示，整體而言，不論女監或是男監之假釋審查委員在判斷假釋與否的決策時，假釋申請人的「犯罪情狀與態度」與「犯罪前科與紀錄」的重要性最高。而且，與女監的假釋審查委員相較之下，男監之委員較不重視受刑人的「在監表現與考核」。

The parole rejection/approval of inmates is subject to the decision-making of parole board members of respective prisons. Studies have found that parole decision-making is affected by multiple factors. However, it is rarely discussed the relative importance and mutual influences among the factors that parole board members consider during the parole decision-making process. Furthermore, the studies of decision-making of parole focus on the parole borad of men’s prison than the wemon’s. Therefore, this study shows the difference of factors influencing parole decision making of parole borad of men’s prison and the wemon’s.
The results show that the major factors affecting the decision-making of parole boards are “crime characteristics” and “criminal record.” And to compare with the parole board of men’s prison, parole board members of women’s prison put more attention to inmates’ behaviors at prison.
