環境影響評估制度民眾參與之研究-以中部科學工業園區第四期為例

摘要


環境影響評估制度係指就開發行為對自然以及人為環境所造成之影響 於事前進行評價。我國環境影響評估法自1994年通過實施至今,對於減輕國內重大開發案對環境所造成之衝擊有一定程度的貢獻,然而隨著民眾意識抬頭,現有的民眾參與機制已無法完全滿足民眾於環境影響評估機制中的需求;在這十餘年間,不少開發案因為開發單位與民眾之間未達成溝通與協調,導致不少民眾與開發業者產生大小不一的衝突,甚至不惜走上街頭抗爭;因此,民眾參與於環評制度中的角色定位值得我們深入探討。 本研究將參與環評之民眾定義為權益關係人,並以中部科學工業園區第四期為個案,透過文獻資料與會議資料之收集,分析民眾參與在環評過程中所產生的問題,並且提出可能的解決之道,以供日後環評之參考。 本研究發現宣傳效果、參與時機等制度設計上需要改善,而此改善方法須有法律進一步規範才能達到民眾參與之效果,同時在進行雙方對話時需先有基本共識才進行溝通,如此一來才不流於各說各話。本研究並以Arestein所設計之民眾參與階梯作為本個案民眾參與之研究基礎,藉由Arestein所設計之民眾參與階梯瞭解到該個案目前僅止於「告知」與「諮詢」階段,民眾參與程度實有再予提升的空間。

The implementation of Environmental Impact Assessment Act, which was promulgated at the end of 1994 in Taiwan, indeed has contributed to reduce the negative environmental consequences of development activities. However, because of the raising awareness of the environment, people are no longer satisfied with the present participation pattern which is limited and narrow. Due to this, when we reviewed several recent development activities, the miscommunication between the project proponents and the residents caused the disagreement about the procedure of EIA. This research addressed the problems arisen from the implementation of public participation based on the case study of The 4th stage Central Taiwan Science Park. By interviewing several key stakeholders, this research concluded that in order to avert disputes, “the public” should be explicitly defined to make the participants’ stance more legitimate and justifiable. In order to derive more concentrated and effective discussion and communication, the consensus should be built when the participation takes place. The public opinion should be protected by laws in order to avoid conflicts and foster the public willingness to participate in the future.
