政策及土地法規影響大陸台商競爭力之研究

摘要

在經濟全球化潮流催化下，臺灣對中國大陸的投資與全球對中國大陸的投資，都是無法避免的趨勢，基於兩岸經濟體系本身個別的競爭優勢、產業結構發展的相互融合。首先台商進入中國大陸投資，除了本身條件外，必須了解中國政策的根源與脈絡，現在中國政策是依據「十一五規劃」執行。
研究結果顯示當臺灣企業選擇赴大陸投資設廠應該特別注意：稅率制度、優惠制度、產業結構與區域優勢，瞭解企業本身競爭力比較。區域研究以華東地區電子電機產業為主，探討臺灣投資廠商與台商的競爭力比較，並對產業結構與產品分析。後續研究針對中國有那些重要政策？與中國土地取得問題為何？有詳細分析與討論。對於個案研究能夠帶給台商企業界作為處理事件的依據與參考。
本研究建議將赴中國大陸投資廠商與相關產業必須詳細研究。最後提出針對中國大陸政策實施應變對策，關於「新勞動合同法」實施注意事項及「勞動仲裁法」相關研究，與工傷處理方式。至於土地取得問題由於中國大陸「物權法」的實施，帶來台商投資中國大陸有更好保障。

With Catalysis of economic globalization, Taiwan and other countries’ investments in Chinese Mainland are unavoidable trend based on competitive advantages of intercoastal economic system and mutual integration of industrial structure. First of all, Taiwan invests in Chinese Mainland, in addition to its own conditions, he must understand the root and skeleton of Chinese policy. Chinese policy is based on the "11th Five-Year Plan".

The results are that when Taiwanese enterprises invest in the mainland to set up factories should pay special attention to: tax system, the preferential system, the industrial structure and regional advantages and competitiveness of the enterprises themselves. Regional studies are mainly in Electrical and Electronics Industry in east China on Taiwan investment firms and the competitiveness of Taiwan businessmen and the industrial structure and product analysis. Subsequently, the paper will pay attention to the Chinese important policies and the issue of land acquisition in details. The case studies can bring Taiwanese business circles as the basis and reference for dealing with the incident.

This study is aimed to Supply information to related industries and manufacturers which will invest in Chinese mainland. , The paper brings forwards countermeasures of Chinese mainland policies, the points for attention of "the new labor contract law," the relative study of "labor arbitration law" and treatments of work-related injuries. Land acquisition problems, because of mainland China''s property law implementation, bring better protection for Taiwanese investment in Chinese mainland. This study is aimed to bringing information to related industries and manufacturers which will invest in Chinese mainland.
