安全(Security)概念在層次上已由單一性的「國家安全」概念延伸至多層次的「個人安全」、「團體安全」、「國家安全」、「區域安全」或「全球安全」概念;而在安全概念面向上,則由傳統上唯一的「戰略─政治」面向擴展至採納多面向的「共同安全」與「綜合性安全」概念之界定,包括政治、經濟、環境、社會及軍事面向。 「政風機構人員設置條例」於民國1992年7月1日制定公布施行,制定當時因有其特殊之時空背景,且在「法務部調查局」主導規劃研訂之架構機制運作,早已不敷現況實際業務之需求,配合政府組織再造政策,修訂「組織法」、增訂「職權行使法規」或「進行計畫性組織變革」等,俾以強化政風機構之組織功能及提升行政效能,整合建構完備之防貪、反貪體系,有效落實反貪倡廉。 政風工作是防腐、興利除弊、提升行政效能、促進機關廉能的工作,其存立有其必要性。透過「政策」與「法制」對話、互動之「科技整合」(interdisciplinary)之研究設計,來探討廉政組織變革問題;故本研究藉由引介美國政治學者伊斯頓(David Easton)的系統理論,和學者宋學文「(3+1)i決策模型」,來分析我國政風機構組職變革之政策制定過程及其在法制面之應用意涵。並探討現行政風機構的運作監管機制及設置之必要性,而提出有效的政風人力配置與運用。最後透過本研究提出符合當代價值體系的政風機構變革思考方向及具體建議。
Security concept has extended from the unity level of “National Security” concept to multi-level of “Individual Security”, “Group Security”, “Region Security”, and “Global Security” concepts. On the concept of security, it has extended from the only “Strategy-Politic” aspect to “Mutual Security” and “Comprehensive Security”, including politic, economy, environment, society, and military-oriented. The department of government ethics works to against corruption and improves administrative efficiency, thus it has the necessity of existence. This thesis discusses the issue of the department of government ethics revolution through the study of interdisciplinary between policy and legislation. Thus, this thesis uses Prof. David Easton’s system theory and Prof. Soong’s (3+1)i decision-making model to analyze the policy-making procedure and the meanings in the legal aspect of our government ethics organization transformation and offer a thought direction and specific proposals conforming to contemporary value through the study.
