身心障礙就業歧視於法院實務判決不常見,但於新聞媒體卻時有所聞,這讓身心障礙就業歧視議題之研究增添些許困難度,身心障礙特質讓身心障礙者無法透過己身之努力去除雇主之偏見,影響其就業機會平等。本論文以職場身心障礙歧視為中心,藉由身心障礙定義與內涵之演變觀察社會對於身心障礙者價值之轉變,並試圖從身心障礙歧視理論探討身心障礙者遭受就業歧視之原因。 本論文除身心障礙歧視理論之探討外,並關注身心障礙就業歧視防治法制無法消弭身心障礙就業歧視原因,故透過法制面之檢討說明現行法令規範之缺失。惟法規範之制定思維常是由上而下之管理方式,甚少關注身心障礙者之意見表達,故本論文乃藉由與身心障礙者之深度訪談以獲得第一手之身心障礙就業歧視現況與問題之相關資料,並將實務上已發生之身心障礙就業歧視個案加以類型化以釐清問題意識。 研究發現身心障礙就業機會平等保障與雇主企業經營權益不可偏廢,方能達成促進身心障礙就業之目的,復因消弭身心障礙就業歧視並非一蹴可幾,仍須依賴教育與身心障礙就業歧視防治宣導之深化,俾讓雇主尊重一般勞工與身心障礙勞工間之差異性,如此才能逐漸消弭身心障礙就業歧視,落實國民就業機會平等保障之意旨。
There are not many cases about disability employment discrimination in Court judgment, but presented on media very often. This situation brings about much difficulty in studying disability employment discrimination issue, because people who have disabilities are always unable to get rid of the employer's prejudice. Further, it is unequal to employment opportunity of people with disabilities. This thesis focuses on disability discrimination in the workplace to examine the conversion of definition and connotation of so-called disability discrimination, and try to observe why people with disabilities are discriminated in our society. This thesis not only discusses the theory of disability discrimination but also concerns the function of Prevention Law Disability Discrimination in the Workplace. Nonetheless, the way of regulation “top-down” process has limited for expression of disability discrimination. This thesis categorizes cases of disability discrimination in practicality, and gets first-material through in-depth interview from people with disabilities to fill up the gape of regulation and reality. This thesis finds that to protect employment opportunity of people with disabilities is equally important to the right of employer's enterprises. And then it will improve employment of people with disabilities. Besides, the government should educate and advocate prevention of disability discrimination, it will advance employer on respect to labor and people with disabilities. By the approach finally, that will carry out real equality to the right to work of people.
