大陸人士與越南人士偷渡來台模式之研究

The Research on the Mode of Illegal Immigrants from Vietnam and China Sneak into Taiwan

摘要

1987年政府開放民眾赴中國大陸探親以來，兩岸民間交流日益頻繁，由於台灣與大陸當時的經濟條件差異之下，促使台灣成為大陸偷渡犯眼中的淘金聖地，在兩岸人蛇集團的操控之下，陸續有大批大陸人民偷渡來台情事。由於近年來大陸經濟也開始起飛，兩岸互動良好，工商界也紛紛前往大陸投資，大陸當地人民就業市場的需求量增加，偷渡來台的意願相對地也降低許多，反觀就外籍人士部份卻是逐年地增加。2007年後海巡署於查獲偷渡案例中，外籍人士偷渡來台的比例已逐漸高於大陸人士。就近年偷渡態樣分析，現階段偷渡來台以東南亞籍人士居多，其中又以越南籍人士為多數，且偷渡來台比例持續增加中。歸咎其原因為我國勞力市場需求，且台灣薪資高於原住地，且有多數被查獲者皆是曾來台打工後，回原住地大力鼓吹同袍相繼前來賺錢，有些企圖改善生活的外籍人士無法經由正常管道申請入台工作，遂而利用各種不法管道進入台灣賺取更多金錢。
海巡署為防止偷渡的第一道防線，肩付查緝走私、防止非法入出國及進出漁港船筏安全檢查等等之任務。本研究時間範圍將以2007年至2013年間，並透過理論與實務進行研究探討。而研究空間範圍以東南亞地區為主軸，大陸地區為輔。以海巡署近年來查獲偷渡的案例中，分析探討各類偷渡來台模式與方式，海巡署於查緝勤務佈署上做何種應變處置及調整，並與現行有關偷渡法令規章中執行情形相比較並做探討，希冀從眾多文獻檢閱的過程中能夠發掘無論在於查緝作為抑或成效相關面向等議題研究的癥結之處。

After since Taiwan government opened family visitor visa to China in 1987, the frequencies of civilian activities exchange has been great increased. Due to the huge economic gap between cross strait at the time, Taiwan became a popular place for illegal immigrant to make money. Because of that, the human smugglers control the gang and has sent many china people to Taiwan. However, the economy condition, higher job opportunities, has great improved in china so that the numbers of illegal immigrant has decreased a lot. Instead, according to the investigation of the Coast Guard Administration After 2007, the illegal immigrant cases from South East Asia has increasing more than China year by year. According from the analyze, Vietnamese is the majority of South East Asia illegal immigrants. The situation of illegal immigrant who are not able to apply legal working visa from Taiwan try illegal way is eue to the domestic needs of labor market in Taiwan also the higher salary than their country. Also, the encouragement from people who had been work in Taiwan.
Coast Guard Administration is the front line to prevent the illegal immigration, illegal abroad and the security check for fishing boat et,. Therefore, my study focus on 2007 to 2013 through the study of theory and practice discussion. Also, the South East Asia is the major discussion and small part of discussion with China. The discussion will base on the investigations of the Coast Guard Administration in order to analyze the method of illegal stowaway operation and the adjustment to deal with the situation, also compare with the execution of immigration law. After all, to discover the investigation difficulties and the effect of the operation from the related research.
