國防組織調整後憲兵的角色及功能－以美、法、台為例
The Roles and Functions of Military Police after Organizational Adjustments – The Case Studies of the United States, France, and the R.O.C.
摘要
隨著時代的演變，憲兵任務不只侷限在於以維護國家元首、維護軍紀、協力治安、支援軍事作戰、維護社會安定、保障國家安全方面的傳統安全。在現今各國往來如此頻繁的社會，軍事以外的非傳統安全威脅是各國都熱切關注的，我憲兵部隊應順應時勢，輔以軍事事務革新的思潮衝擊，針對本身各階段功能角色之變遷，並研究體察世界各主要國家憲兵制度潮流趨勢，以提供我國憲兵未來建軍發展新思維的方向，達成國軍「全備戰」的目標，進而塑建現代化優質憲兵之新形象。 我國憲兵具有軍、司法警察身分與職權，可依法執行偵監預防、糾察舉發、摘奸發伏、防處犯罪，以維護法紀，協力警備治安；另於戰時支援三軍作戰，確保國家與軍事安全及社會安定，憲兵的角色可說是兼具軍人與警察的功能。雖具以上種種功能，我憲兵組織仍須因應當前國家需求，配合國防政策及建塑新型態憲兵，以迎接新時代的挑戰。 憲兵本身具有多重且專業的任務特性，且在軍隊中有著重要的角色地位，因此各國對憲兵的倚賴性在近年來可說是有增無減，我國憲兵雖也在各個時期都扮演著非常重要的角色，但在近期一連串的國軍政策改革，使得本國憲兵員額不斷縮減，在面臨如此軍事改革下，我們也需重新思索憲兵的真正價值，讓其在未來能賦予憲兵新的發展與重視。

As the wheel of time turns, the tasks of military police are not only limit in traditional security affairs, such as the safeguard of president, the stability of society, the military war supporting, and regulate the behavior of military. In nowadays, every country has concerned not only on traditional security but also on non-traditional security; therefore, our country should follow the trends which should combine the innovation of military affairs, and changing the R.O.C military polices’ functional roles at different stages. Also, R.O.C military polices should research or observe on other countries’ military police system in order to provide the future direction that helps us to develop new knowledge of the R.O.C military polices. For the purpose of reaching the final goal "all preparing for", they should build the quality image of the modern military police. R.O.C military police is an authorized police and army which means they have the function of assisting the daily jobs of police such as criminal arrest and criminal investigation and also can join the army to accomplish mission in wartime. However, although with all these features, R.O.C military police organization should satisfy the national defense policy needs. After organizational adjustment, the new type of military police will be established and be ready for the future challenges. The missions of R.O.C military police are not only complicated and professional but also essential in military as well. The reliability of the military police in other countries is increasing. That is why every country is more emphasis on military police’s importance and relies on them for the national security. R.O.C military police also play all kinds of important roles in military and never absent in every periods of R.O.C’s history. Also, our government’s policies of shrinking the military police these years are now become controversial; therefore it is the time we must be seriously reevaluated the value of R.O.C military police. We must not neglect the importance of them, and develop new features for them to be emphasis.
