現行土地徵收條例下落實協議價購精神之執行問題：行政法院之判例分析

近年來，國家為了推動經濟政策，進行大規模土地開發，中央與各地方政府動輒以徵收方式取得所需用之私有土地，導致土地所有權人抗爭事件不斷；更引發學者、專家與社會團體的批判，使得土地徵收議題成為近年來社會關注的焦點。尤其苗栗大埔徵收事件之被徵收土地所有權人更提出訴求：暫停目前全台的土地徵收案件以及推動立法草擬修正「土地徵收條例」這個「惡法」。「協議價購」前置程序為土地徵收程序之一環，惟現行協議價購條文規定內容簡略，制度不備，需用土地人應如何踐行「協議價購」此一程序？再綜觀土地徵收案件土地所有權人抗爭的訴求重點，大抵為徵收之濫用以及徵收補償費額過低等問題。據此，本文主要針對現行「土地徵收條例」規範「協議價購」機制的真正意涵以及需用土地人實際執行運用等問題進行研究探討，並以近年行政法院相關裁判為主要研究素材檢討分析，最後提出研究心得，以為未來「土地徵收條例」修正時之參考方向。

ABSTRACT

In recent years, In order to promote national economic policy , the Large-scale land development of government is in full swing. So as to obtain the land ,The central and local government expropriate the private land, Leading to land owners protest incidents continuously. It has triggered off the criticism of scholars, experts and social groups. So the land expropriation issues become the focus of attention. Especially the expropriation of the farmland in Dapu Village of Miaoli County event, The expropriated land owners bring up more demands to stop the land expropriation in Taiwan and to promote legislative drafting amendments for Land Expropriation Act, the draconian law. An agreement concerning the amount of compensation is one of the pre- procedure for expropriation, but the content and system, of the act for agreement, is brief and not prepared. How the man land required carry out the procedure of the agreement concerning the amount of compensation ? Looking again on the focus of the expropriated land owners protested against the expropriation , is abuse of expropriation and compensation amount too low. After all, the real meaning of this study is to find the mechanism of the agreement concerning the amount of compensation of the Land Expropriation Act and the issue of the actual implementation for the man land required. This study also Reviewing and analyzing related referees of administrative court are also the main research material. The research experience will provide the reference direction of amendments for Land Expropriation Act.
