按所謂土地徵收係指國家因興辦公共事業或實施國家經濟政策之需,依據法定程序強制取得私人土地權利,並給予合理補補償之一種行政行爲,核其性質應屬行政處分,其中爭議最大者即爲補償價額。爲妥予解決,我國土地徵收條例第22條乃賦予被徵收土地權利關係人對該價額提出異議之權利。又,爲減少訟源,提升徵收之行政效率,該條第1、2項規定主管機關負有「查明處理」義務,於必要時並送請地價評議委員會「復議」。被徵收土地權利關係人若對復議結果不服時,得依法提起行政救濟,其中所稱「查明處理」以及「復議」乃本文所稱補償價額爭議之(先行)「行政解決」機制。然於實務上,由於土地徵收主管機關對於補償價額之爭議有權決定是否送請地價評議委員會「復議」,又,復議結果何時通知被徵收土地權利關係人,亦未明定,凡此皆已弱化旨揭條項之規範目的,再者,旨揭行政解決機制是否爲行政救濟之先行必要程序,亦引發最高行政法院之重視而做出決議。雖是如此,基於土地徵收具有「強制剝奪」私人土地權利之特性,本文乃思考以被徵收土地權利關係人之「權益」爲基點,並將其利益內涵具體化爲「程序利益」與「實體利益」兩項指標,再運用法律經濟分析法予以分析,最後,並對旨揭土地徵收條例第22條第1、2項提出建議,以作爲本文之結論。
Land expropriation means that the state has right to expropriate private property for public use according to regulated procedure and must compensate the loss of land-owner. During the land expropriation, the most important for land-owner is the quantity of compensation. In this context, it exists the so-called ”administrative disputation solution” mechanism according to §22 of the ”Land Expropriation Act”. In other words, the land-owner has right to give opposition to authority about he quantity of compensation, After that, the authority have to explain the contradiction and ask the help from ”Land Value Appraisal Committee” in need. These are the so-called ”pre-administrative solution” mechanism regard to ”disputation solution” of compensation quantity by land expropriation. However, the function of ”disputation solution” mechanism fails to the mentioned goals in the practice. Therefore, this article tries to explore the reasons with method of ”economic analysis of law”. After analyzing, some suggestions well be proposed regad §22 of the ”Land Expropriation Act” for authority.
