婚暴婦女撤銷民事保護令因素與影響之研究-以高雄市為例

摘要

我國「家庭暴力防治法」（domestic violence protection law）自1998年經立法院三讀通過及總統公布實施後至今已屆十年（以下簡稱家暴法），當中家暴法中的重要特色－保護令（protection order）亦運作了九年餘。由於保護令制度的設立，使我國家庭暴力防治與協助工作邁入了一個新的里程碑，並為婚暴婦女打開了希望的大門與求助的管道。
本研究旨在了解婚暴婦女撤銷保護令的原因與影響，因此，針對以下的問題深入探討：
一、了解婚暴婦女撤銷保護令後之現況。
二、探討婚暴婦女撤銷保護令之因素與影響。
三、探討社工人員對於婚暴婦女撤銷保護令之見解。
四、探討法官對於審理婚暴婦女撤銷保護令之考量與見解。
本研究係以探索為目的，運用質化研究方式進行個別深度訪談，計訪談三位家事庭法官、十位社工人員以及三位婚暴婦女。針對上述受訪對象的經驗與看法，藉由生態理論架構之個人、家庭、社會結構及社會文化進行分析。
研究結果發現：婚暴婦女聲請撤銷保護令的原因有：1.條件交換2.遭施虐者恐嚇、威脅3.親友勸說4.加害人處遇計畫5.維持家庭和諧、完整6.對司法的負面觀感，撤銷保護令對婚暴婦女的影響則有：1.失去保護、增加風險2.經濟與托育雙重困境3.無法走出受暴陰霾4.親子關係惡化5.正式資源浪費6.恐影響再次聲請保護令。
最後，研究者根據在上述的研究結果，提出研究討論和建議，以供未來修法及相關工作人員因應的參考依據。

In Taiwan, "Domestic Violence Prevention Law" has been released through the Third Reading of the Legislative Yuan and announced by the president since 1998. One of the important parts in the law-Protection Order-has also been used for over 9 years. Because of the establishment of the protection orders, the domestic violence prevention and assistance work has entered a new milestone in women's marital violence and open the door to hope for help with the pipeline.
This study aimed at the understanding of the reasons and effects of abused women’s abating protection orders. Therefore, this studied focused on the following questions:
1.To understand the current situations of the abused women after the abatement of the protection orders.
2.To discuss the reasons and effects of the women’s abating protection orders.
3.To discuss the points of view of the social workers on the women’s abating protection orders.
4.To discuss the points of view and the consideration of the trial judges on the women’s abating protection orders.
The purpose of this study was for research. 3 domestic judges, 10 social workers, and 3 abused women were interviewed individually by using the qualitative research methods. Focused on the points of view and the experiences of the interviewees, this main topics were discussed and analyzed in this study based on the individuals, the families, the structure and culture of the society in the ecological theory.
This study showed that the reasons for the women’s abating the protection orders are the following: 1. the exchange of advantages 2. the intimidation and threats from the abusers 3. the persuasion of friends and relatives 4. the plans of the abusers 5. the purpose of maintaining the peace and harmony in the family 6. the negative impression of the judiciary. The study also showed the effects of the women’s abating the protection orders: 1. the losing of protection and the increase of risks 2. the difficulties of both economy and child care 3. the difficulties of out of the abuses 4. the deterioration of parent-child relationship 5. the waste of social resources 6. the negative affection of reapplying for protection orders.
Finally, according to the above results of the research, the researcher provided the advise and suggestions for the law’s amending and the related staff in the future.
