摘要

本研究著眼於臺灣公私部門外勞的政策與管理、營建人力就業狀況與運用、外勞與雇主以及仲介業者三方面進行探討，方法包括蒐集相關文獻探討分析、綜合實務上與管理機關所接觸之經驗分享，針對外勞對營建業界潛在因素之影響加以研究，期待通過本研究成果提供相關單位可能之改善因應對策。
建議管理機關應對企業單位外勞管理與督導、外勞業務檢查、仲介業有效管理，配合相關法規與政策持續落實推動外勞業務，評估營建外勞與本國營建勞工人力結構性因素，改善營建業勞工人力短缺並合理性的保障本國營建勞工就業意願。期待本文能供作其它公部門、民營工程建設公司管控營建外勞人力參與工程建設時的參考，同時也期許本文針對政府外勞政策與管理有更明確、完善的指引方針。

The research was conducted with focuses on (1) foreign worker administration and policy-making process by the government agencies and authorized organizations in private sector, (2) influence imposed by foreign workers on domestic labor market in construction industry, and (3) relationship between foreign workers, employers and brokerage. The study was carried out on the basis of practical cases with the use of document review and analysis, experiences accumulated and shared between the author and several related government agencies during practical application of the law enforcement on foreign worker administration and domestic labor management with respect to the protection of domestic workers and quality of the construction projects in which foreign workers have been introduced for more than 25 years.
The conclusions of the study include (1) effective supervision and inspection by the authorized agencies on the foreign labor employment process by the brokerage, (2) more accurate and precise evaluation of the influence of foreign workers on the domestic job markets and quality of construction projects, and (3) immediate establishment of government polices regarding rationalization of the construction job market and solutions for reduction of labor shortage of domestic workers due to relative low salary and high risks of jobs in construction industry. Conclusions and improvement tactics were drawn and recommended in the study as useful references for all related parties regarding the influence and administration of the foreign workers in Taiwan.
