摘要

本研究係基於近些年來，行政院所轄獨立機關的運作上衍生處理個案的重大爭議，學術界宜有所思考，如何健全各該獨立機關和行政法人的組織法制，以促進獨立機關和行政法人有名實相符的組織定位，並且有效行使法定的組織職權，是以本研究係針對現已制定的獨立機關與行政法人組織法律，分析各該組織法制與政府擬進行政府組織改造時所訂頒的建制原則，以及經由立法所制定的通則性組織立法之比較，如：中央行政機關組織基準法行政法人法進行比較，比較分為法規（政策）環境影響評估、現行法制規定和執行等二階段之評析。隨之，研擬健全獨立機關和行政法人的組織法制的修正取向，以供政府未來進行修法之參考。

This paper is written to analyze legislation about independent executives and administrative corporations in Taiwan. There were many disputable events during they were operated specific cases for independent executives in the past. We had compared different aspects between building principle and organizational legislation, then we will draft to feasible a guidance or framework of legislation for independent executives. We had discovered many good legislation for administrative corporation At present, there is a important trouble with autonomous finance for many administrative corporations. The control bodies ought to design a good strategic plan forever. This paper is written a conclusion that not only independent executive needs a good organizational legislation, but also administrative corporation need a stable finance resources.
