刑事司法戒治處遇制度之問題與困境研究

摘要

毒品犯罪向來爲我國重大犯罪問題，即便刑事司法體系戒癮治療成效難以彰顯，但在醫療人力、經費等相關問題的現實考量下，刑事司法也成爲承擔毒癮戒治工作的主要體系。本文將對整體刑事司法戒治處遇制度問題與困境進行探討，並提出改善建議。研究資料以質性訪談爲主，個案包含戒治所專業人員，以及監獄（含明德戒治分監）毒癮累再犯。總結我國當前刑事司法體系毒癮戒治主要問題在於：戒癮人力資源不足、欠缺成癮性與毒癮改善評估、處遇措施無法因應戒癮所需、戒治工作侷限機構內、刑事司法約束力欠缺彈性、社會整體戒癮資源仍有待發展等。

Drug crime has always been our serious crime problems, even though the efficiency of addiction and treatment is not manifest, however, under some reality circumstances consideration like medical treatment manpower, budget and etc, the criminal justice policy still play an important role in the drug policy. The essay will make discussion about the whole addiction and treatment problems and difficulties of criminal justice system, and provide some improvement suggestion to the conditions. The research materials is collected in the way of depth interview and choosing some cases, including professionals working in Drug Abuser Treatment Centers, and imprisoned drug offenders and recidivists. In conclude, the study put forward the problems and difficulties mainly concentrate on the lack of manpower for addiction and treatment implement, the short of evaluation for addiction improvement, treatment treasures can not meet the reality need, the treatment programs only focus on the institutions, the deficiency of criminal justice flexibility, and the prospect of development in addiction and treatment sources and etc.
