摘要

我國預告登記制度係仿效德國，然幾經修正，已與德國制度有所不同，且現行土地法第79條之1規定預告登記條文解釋又頗多疑義，是本文透過比較法及立法沿革等法學方法論上之解釋，並以院字第1958號關於優先購買權解釋為引，檢討預告登記之要件。
