國際間關於研發國際化所涉事項之規範研析

面對研發國際化之全球趨勢，我國實處於一個必須靈活以對之地位。依據OECD之調查，我國與新加坡並列為跨國企業設立海外研發據點的第11名，足見我國具備吸引創新研發者來台從事創新研發活動之先天條件，我國政府實應利用此一優勢建構優質的國際合作研發環境；針對此議題，國際間多簽訂國際科技合作協議的（STA）為之，本文以下擬以歐盟「國際科技合作之歐盟策略架構」以及國際間新近STA條款為觀察，提供我國相關主管機關擬定國際研發合作策略以及設計STA條款之參考。另外一方面，我國政府長期投注公資源於扶植產學研各界研發創新活動，於特定領域中甚有居國際領先地位之成果，而經濟部科技專案計畫更屬推動我國產業技術創新研發之關鍵機制。妥此，我國主管機關對於國有研發資源及受國有研發資源支持而產出之研發成果（特別是屬領先地位者）移往境外從事研發活動者，也應予以妥適管理，始能長期地維持並提升我國整體產業技術競爭力。針對此議題，本文將以美國商務部國家技術與標準局依所推動之「技術創新計畫」，以及韓國「產業技術防止外流及保護法」為觀察對象，探求其他國家在管理國有研發資源及受國有研發資源補助而產出之研發成果之境外運用所採取之管理思維與具體作法，期能藉此提供相關主管機關一個較具整體考量之管理觀點。

In the face of the global trend of internationalization of R & D, Taiwan should leverage its highly-potential position smartly for its development and prosperity. According to the statistic data made by OECD, Taiwan received high remarks by international enterprises for their preference of establishing R&D department; it has shown that Taiwan has the advantages of attracting innovators aboard to promulgate their innovation activities in Taiwan. The authortity concerned shall take the advantage and make a more intenational R&D-friendly environment to attracte R & D investment domestically. As to the issue, the article finds that Agreement on Science and Technology Cooperation(STA) will be a crucial element that help to make it a more transparent and stable environment, therefore, the article will not only observes the principles made by EU that help to form their internation R & D strategy, but also give some advices on setting STA provistions by making a comparison to those latest STAs concluded by other countries. On the other hand, since industrial, academic and research sectors' innovation activities have been funded by Taiwan's government for a long time, there are cutting-edged R & D results that lead the world in certain area,. However, while the use of the those R & D recources and results aboard seems inevitable under the trend of inteternational R & D, it is the duty of the authorites concerned to set an appropriate mechanism to regulate the use of those public funded R&D recources and R & D results aboard to maintain its competitiveness as a whole. By observing the related regulations made in Technology Innovation Program and the Act on Prevention of Divulgence and Protection of Industrial Technology, this article is trying to demonstrate the different management ideas hold by governments of USA and Korea in regulating their use of public-punded R & D resouces and results aboard.
