政治とカネにまつわるスキャンダルは、古今東西、中央•地方の政界を問わず、いたるところに生じる。権力者はつねに、カネの誘惑にさらされているが、その自覚がきわめて薄れているといわざるをえない。したがって、権力者たちは政治の世界に身をおくものとしての規範を確立するのみならず、「開かれた政府」を確立するための制度的工夫も必要とされるべきである。この法的規範として最も重要な手段の一つは、情報公開制度である。とくに政治とカネをめぐるスキャンダルが多々生じる日本では、政府情報の公開を求める市民の要求はとりわけ強くなった。しかし、国より地方自治体の方が先駆けて情報公開制度を導入している。本稿では、日本の例を中心に、法的及び行政的な観点から、情報公開制度の沿革、根拠、内容を検討する。
Scandals concerning politics and money occur everywhere, through all ages and countries and at the levels of central or local politics. Those men of power are always exposed to the temptation of money, and it is extremely difficult to ignore. Therefore, to establish a model for regulating those men with power in the world of politics, a device of the ”Open Government” is required too. One of the most important means as a legal rule is the system of public information disclosure. In Japan, because the scandals concerning politics and money occur often, the civic demand for the exhibition of administration information became very strong. The local government, however, established the legal system of public information disclosure even earlier than the central government. This paper focuses on Japanese examples and examines the history, ground and contents of the system of information disclosure from the legal and administrative viewpoints.
