數位時代著作權相關法律及管理問題之探討

摘要

由於數位化技術的不斷發展，改變我們的重製及散布資訊之方式，從而發生不少著作權法律及其管理的問題，例如網際網路中，利用他人有著作權的信件、軟體、資料庫等資料，可能構成侵害著作權，以及著作權歸屬、數位著作、網路連結、合理使用、著作權集體管理等問題。此外，在著作權法概念之變革方面，如修正中著作權法的新興議題，例如暫時重製、公開傳播權、技術保護措施及權利管理資訊等問題，均屬因應數位時代相當重要的著作權議題。因此，本文參考目前國際間發展趨勢，就這些問題，加以探討，並試提供若干建議或解決看法，以供參考。

The rapid expansion of our ability to reproduce and distribute information by digital means has occurred a lot of the issues about the copyright law and its management. We take some problems for example using the data from email, software and database of another person in the Internet. Besides, in the field of the modification of the copyright law, some new issues, such as a temporary reproduction, the right of communication to the public, the protection of a technological measure, copyright management information and the collective management of copyright, also play an important role in the digital age. This article will discuss the above questions with reference to the international development and we will try to provide some suggestions to solve them.
