本文以勞動派遣是否有合法存在空間此角度切入,先闡述1997年國際勞工組織第181號公約,在確立了派遣機構得以存在的前提後,遂說明並分析以2008年為準之各國勞動派遣規範,進而得出國際上承認勞動派遣為合法的工作型態之趨勢。又於分析並歸納2008年各國勞動派遣之立法政策後,得出歐洲國家甚具參考價值之心得。 又就法制分析之範圍而言,國際上雖多承認勞動派遣的合法性,但多仍設有相關管制規定。因此,本文主要聚焦於近來建立勞動派遣相關法制過程中,討論最熱烈的問題。即勞動派遣的使用範圍及期間要件限制。然為建立具體且周全之規範機制,不應僅討論限制勞動的使用措施,亦應注意有關對於派遣勞工的保障。因此,本文亦說明需與勞動派遣的使用管制配套的措施,如對派遣業之行政管制及對派遣勞工之平等待遇等。最後,則提出對我國勞動派遣的具體立法建議。
The notion of“Flexicurity”has been emphasized in European countries. As the result, the regulation of temporary agency work is worth referring. This thesis focuses on the restriction on using temporary agency work and duration of assignments in the European countries. Also, this thesis tries to draw some conclusions on the importance of equal treatment as regards to pay for agency workers and the special administrative authorization for temporary work agency. In the final chapter, my comments, based on the above conclusions, on the“Draft of The Temporary Agency Work”might provide policy makers and the public with different points of view on temporary agency work.
