土地使用變更審議會議紀錄品質評估之研究-以區域計畫委員會為例

摘要

為土地開發之需要，個案變更審議乃各種土地管制審議委員會之經常性作業。然而，土地使用計畫變更審議的結果不但關乎申請人及相關利害關係人之權益，甚至引起重大社會爭議，是以審議會議紀錄乃是事後外界所能窺知審議過程之重要依據。一方面，隨著公民意識高漲，社會要求政府各項資訊公開面向及深度的聲浪亦逐年提高。另一方面，民眾對於土地使用計畫變更審議結果不服或有所異議，循行政救濟程序向司法機關提出訴訟，會議紀錄也是司法解決過程中，瞭解會議過程之重要審判依據，會議記錄品質至為重要。
本研究以區域計畫委員會作為研究對象，先就該委員會其功能、組成及會議運作先行瞭解，而後針對其對會議紀錄之內容進行探討，並建立會記錄品質之評估指標。對於現行區域計畫委員會之會議紀錄，分別就其完整度、正確性、效率性及易讀性各評估指標分析其紀錄之品質。結果顯示，會議紀錄記載項目之完整性實際上已能符合一般會議紀錄所之製作規範，發言紀錄完整性方面，具備完整之記載內容在比例上尚屬少數討論議案；會議記錄在文字錯誤率不高，發言內容亦利用影音紀錄作為文字紀錄之參照，降低內容修正之情事；會議紀錄之製作與資訊公開時間均花費較長之時間；會議紀錄之判讀應增加其易讀性，以利讀者能更有效率地閱讀。
土地使用計畫變更審議機制除區域計畫委員會之外，都市計劃委員會及環境影響評估委員會也有類似問題。本研究之成果應可提供相關委員會審議未來撰寫會議紀錄之參考，提高會議紀錄之品質，降低社會之衝突成本。

To cope with land development, review of land use rezoning is a typical job for land use control committees. The result of review will not only influence the property right of applicants and other stakeholders, but also cause social disputes in some cases, and therefore, the meeting minute becomes the key for others to understand the review process. On the one hand, demand for public information is increasing due to democratic progress; on the other hand, private land users often propose lawsuits if not satisfied with the review results. As a result, the meeting minute becomes the important document for judicial authorities to know the meeting process when making judicial decisions. Therefore, the meeting minutes become the basis of legal disputes.
In this thesis, the Regional Planning Committee targeted for case study. First of all; quality indicators are identified for the evaluation of meeting minutes, namely, completeness, accuracy, efficiency, and readability. It was found that most meeting minutes meet the general requirement in completeness of items. Yet, the completeness of record on discussion process was not adequate. Rate of error in the meeting minutes was low. Most meeting minutes requires long time to make before release to the public, while readability of meeting minutes should be improved either
In addition to the Regional Planning Committee, other review committees such urban planning and environmental impact assessment, similar issues happened either. It is hoped that the suggestions in the research will be helpful to the future production of meeting minutes so that social conflict cost can be minimized.
