企業對於自身智慧財產的保護越來越重視,在大家紛紛將技術申請專利時,專利的形成將阻礙新技術的產生,專利池成為解決專利叢林的重要解決方法。然而學術與實證研究對於專利池的建置對專利池與專利權人的創新究竟是助力或阻力亦有爭論;以及學界並未著墨基於同一技術標準彼此具競爭關係的複數專利池,是否因競爭而影響其專利創新活動。本研究以DVD-3C與DVD-6C專利池中1986至2010年間的專利為研究對象,透過數量指標、複合品質指標檢驗專利池成立對於創新活動的影響屬於正面或負面;以及兩專利池重疊產品類別的創新績效是否優於非重疊產品。最後本研究發現,專利池對於創新活動有負面的影響,另一方面具有競爭關係的產品其創新績效皆優於非重疊產品。
One of the most effective solutions to patent thickets is the patent pool which multiple licensors unify to license their complementary patents in a package. However, academic researches and empirical investigations are not consistent in whether patent pools encourage innovation performance. And few literatures have focused on competition effect on competing patent pools which promote similar technology. The objective of this study is to examine innovation performance of two competing DVD patent pools (DVD-3C and 6C) by applying patent count, composite patent indicators from 1986 to 2010. Finally, this study found that the formations of these two patent pools discourage innovation activities, and the innovation performance of overlapping products is better than non-overlapping ones.
