本文探討我國政黨輪替後民進黨執政時期的黨政關係,並將其放置在一種半總統制經驗類型的比較視野下來理解。現有文獻比較多探討政黨對於黨政關係和憲政體制運作的影響,而幾乎很少論及特定憲政體制對黨政關係和政黨的影響。半總統制存在著實權總統,總統與所屬政黨的關係,特別是其是否同時爲執政黨的黨魁和領導人,位居黨政關係金字塔體系中的頂端,具有牽引次級體系的作用。本文首先勾勒我國黨政關係的三項結構特質:「憲政現實上」屬於總統優勢的半總統制型態、分立與少數的政府、黨政菁英的山頭化;其次,整理並分析民主的半總統制國家總統是否兼任黨魁之經驗;最後,再檢視台灣案例。作者發現,傾向總統優勢的半總統制國家,確實比較會出現總統兼黨魁的情況,而本文案例亦屬此種類型。陳水扁任期之初雖以「全民總統」自居未兼任黨主席,試圖與所屬政黨保持距離,於是無法避免總統必須同時在政黨與政府中建立代理人(黨主席與行政院院長)的現象,且總統與執政黨都需要費力建立體制外各種決策諮詢機制和黨政聯繫平台,再加上總統若無法有效掌控政黨,會發生總統意志與黨意可能的落差等等現象。這些併發現象,無法從半總統制的特性單獨獲得解釋,但確實可以從中得到部分線索和解答。進一步的,爲了因應這些現象所帶來的黨政關係問題,實權總統在任期內逐漸朝向兼任黨魁以及更有效掌控政黨的方向使力,這樣的黨政關係會再牽引對總統所屬政黨的影響,帶來一定程度「總統化政黨」現象,是政黨研究領域中頗值關注的重要課題。
This paper tries to analyze the party-government relationship in Taiwan during the Chen Shui-bian presidency. The relationship between the ruling party, that is the Democratic Progressive Party (DPP) and Chen Shui-bian's government should be considered under the structure of president-dominant semi-presidentialism and ”divided-minority” government. Furthermore, with respect to the presidentdominant semi-presidentialism, the core dimension of party-government relationship is concerned with how the President deals with the relationship between himself and his party. The author first discusses the experiences of other democratic countries than have adopted a semi-presidential system. Subsequently he moves onto discuss the Taiwan experience of semi-presidentialism. The overall conclusion is that regardless of whether the President is also the chairman of the DPP or not, he is still both the real leader of the party and the final decision maker of the government. Even so, the patterns and mechanisms of the party-government relationship were fluid during and alternating the different periods of the Chen presidency. However, under the structure of president-dominant semipresidentialism, there is the tendency that the president will be also the chairman of his party so as to control the ruling party and government more effectively. Finally, the phenomenon of ”presidentialized parties” is an important issue which needs to be tested further.
