摘要

法律的適用看似簡單，然而實際上卻涉及到法規範的解釋方法與邏輯論證。本文從法律適用的基本意涵，扼要討論常見的解釋方法與邏輯論證形式，於文中並列舉近年來與刑事司法裁判有關的事例，作為主要探討的對象，希冀能從法學方法論的角度，窺探近來實務運作之情形。

This paper begins with the basic meaning of the applicable law, briefly discusses the common interpretation methods and logical argument forms, and includes a related criminal case in order to explore the operation of criminal justice practices.
