性侵害防治中心在司法流程中的角色－減少性侵害被害人重複陳述作業之評析

摘要

台灣在民國90年將刑法中的妨害性自主罪從告訴乃論，改為非告訴乃論後，幾乎所有的性侵害被害人被迫進入司法程序中。內政部於民國89年開始草擬『性侵害案件減少被害人重複陳述作業要點』，經過相當周詳的思考和設計，花費數年的時間完成相關的法定程序，在各縣市的推動下已經獲得顯著的成效。本文即是從被害人服務的觀點，檢視此項措施的意義和評估執行問題背後的原因，並建議未來的解決之道，以達成兼顧司法正義和保護被害人的雙重目標，使被害人因而願意報案進入司法流程，有助於預防性侵害的使命。
本研究發現此減述流程，出現六大參與者定位的模糊，造成實際上專業團隊無法建立。其中的主因，是社工員專業角色的弱勢，無法發揮減述流程負責人的角色，也無法重視和被害人建立信任關係的專業責任。因此，本文建議從四大層面的工作方向來根本改進性侵害被害人的專業服務體系，以其最終達成預防性侵害的使命。

Taiwan has sexual assault law reform in 2001. Previously all the rape cases were initiated by the victims themselves for prosecution. Since the law reform, it is required that the state prosecutors will automatically be responsible for all the prosecutions, and almost all the rape cases will enter the legal procedures. Therefore, in order to protect these rape victims, the Ministry of Interior has initiated a procedure call ”the program of reducing repeat interrogation for victims of sexual assault” since 2000. It was carefully designed and has completed all the legislation processes. It has been carried out by several counties and rendered significant results. This article is from the perspective of providing service to the victims, to examine the meanings and factors behind several problems and to suggest future resolutions. It is hoped that the dual missions of sustaining justice and protecting victims will be possible, so that the victims will be more willingly to ender the legal procedures and thus the possibility of preventing sexual assaults.
This research found out that ”the reducing repeat interrogation program” has six ambiguities in defining separate roles during the procedure. The main reason is the weaker position of social workers among participating professions, and therefore, the sexual assault response team can not be successfully formed, and the trust formation between the victims and the social workers is ignored. Therefore, this article has suggested four dimensions for rape victim service improvement in the future.
