論文提要內容 本研究係針對政府共同供應契約採購弊案和白領犯罪機會節點理論(Benson, 2009)深入研究,彙整近年共同供應契約採購相關弊端案例,分析其犯罪模式,並從中歸納制度中的成員與交集的「節點」、「路線」及「邊緣」,以提供相關單位切斷制度中的「節點」,並且研擬監督及防制對策之參考。 本研究之研究方法係以深度訪談法進行,訪談對象則限定為曾經偵辦過共同供應契約採購弊案之5名執法人員,研究結果發現,共同供應契約採購弊案之特性共有下列5項: 一、掮客集團的重要性 二、綿密、在地的網絡 三、建立信任感:發動者接近民代與公務人員的路徑 四、如何灌水與酬佣 五、迴避被發覺技巧 本研究提出防制共同供應契約採購弊案之策略如下: 一、修正共同供應契約採購制度 1. 限制共同供應契約採購制度僅適用於單純、例行、一般事務性之品項採購 2. 落實採購品項比價與訪價 3. 加強採購人員之職能訓練 二、強化節點監控,降低犯罪機會
ABSTRACT The study aims to further explore the official government joint purchasing contract misconduct and white-collar criminal opportunity nodes theory. It compiles the related misconduct cases of recent official government joint purchasing contract misconduct, analyzes the underlying crime patterns, and sums up the institutional members and converging “nodes”, “routes” and “edges,” so as to help the authorities cut off the “nodes” of institutions and provide advice about monitoring as well as preventive policies. The research method of this study was in-depth interviews, and the researcher confined the subjects to five law enforcement agents who once investigated official government purchasing contract misconduct. The result showed there were five characteristics of official government joint purchasing contract misconduct as follows: 1. the importance of broker groups 2. a dense local network 3. building the sense of trust: the initiator’s way to approaching representatives and civil servants 4. ways to exaggerate and offer commission 5. techniques to avoid being caught To avert and prevent official government joint purchasing contract misconduct, based on the study results, the researcher proposes the following strategies: 1. It’s advised to fix the system of signing official government joint purchasing contracts. A. It’s advised that the signing of official government joint purchasing contracts is to be restricted to merely simple, routine, and general item purchases. B. People in charge should substantiate price comparison for intended items. C. It’s vital to enhance the training of the personnel in charge of purchases. 2. It’s advised to strengthen the supervision of nodes so as to reduce opportunities of committing crimes.
