從行政院公報新制談資訊公開與民眾參與

摘要

政府資訊公開是當代社會對於政府的根本訴求，也是民主政治發展的關鍵，而完善的政府公報則是民眾有效獲得政府資訊的制度要件。過去政府公報缺乏資訊公開思維，以及官僚本位思考，使得公報發行缺乏整合機制與「顧客導向」精神。民主社會以及資訊社會的來臨，形成對於政府資訊即時而完整公開的強烈訴求，在在促成政府公報的改革。
本文檢視政府公報改革的內容，並透過脈絡觀點，一方面檢視台灣民主轉型的民主化面向，特別是資訊公開法制改革與政府公報改革的互動；另一方面檢視政府公報改革與電子化政府的關係。
本文認為民主轉型帶來政府資訊公開的訴求，而現行公報制度降低獲得資訊成本，成為民眾參與公共政策的誘因，有助於深化民主政治。其次，政府公報也承載資訊通訊科技變遷帶來的時空壓縮，解除政府資訊公布的時空限制。再者，政府公報制度強化人民參與政策的量能，挑戰了傳統賦予行政權正當性的傳送帶理論。此外，公報制度降低使用政府資訊的成本，也重新調整民主參與的代表性與公平性。最後，政府公報制度形成政策推銷的媒介，對於民主政治的治理效能扮演了積極的輔助角色。

Government gazette could function as the fundamental mechanism for public information disclosure which stands as the backbone of democratic governance. In the wake of democratization and information revolution, there has been demand for reforming the government gazette system that used to be disintegrated and thus user unfriendly.
This paper analyzes the path of integrating current government gazette over recent years, taking a contextual approach that looks into Taiwan's democratic transition, the development of information society and the e-government initiative.
This paper identifies democratic transition as the critical driving force behind Taiwan's institutionalization of information disclosure and subsequently a better government gazette system that serves to reduce the costs of gathering information for decision making and to facilitate meaningful citizen participation. An integrated government gazette also serves to change the legitimacy of the government from a congressional transmission belt model to a participatory mode.
