臺灣地區原住民族政策對礦業開發影響之探討

摘要

由於礦業開發區域與原住民族土地重疊性高，受原住民族的影響已不容忽略，藉由本文的分析，整理出礦業開發與原住民族權益間可能遭遇的問題，並就如何降低衝擊，提出3點因應建議：1.就礦產資源自主開發之必要性，提出具體說明，以爭取相關機關或立法院在修法上之支持。2.落實原基法第21條之時點，應於核定用地或土地續租時，辦理較為妥適。3.業者應落實場區環境與景觀維護工作，以提昇產業正面形象。

It has a high overlapping of mining development area and indigenous land, so the effects of indigenous peoples can't be ignored. With analyzing possible problems between mining development and the rights of indigenous peoples, this article has suggesting 3 possible solutions as below: 1. To persuade counterparties or the Legislative Yuan by providing concrete evidence. 2. The time for implementing the Indigenous Peoples Basic Law article 21 will more appropriate when applying for approval of mining industry land or leasing of land. 3. Enhance positive image of industry by implementing maintenance of field environment & landscape.
