論勞務採購與勞動法制之關係

摘要


政府部門常以勞務採購方式,由政府採購法的運用中,獲得所需的人力。如此的勞動力取得方式,實已涉及違反勞基法第5條及第6條之問題。如此的採購作法,雖狀似外國法制中之勞動派遣,然在我國目前則係無勞動派遣法下,避離勞基法束縛的脫法行為。何況將勞派人力一用十餘年,亦為外國法制明文禁止。這些問題的發生首自政府採購法對勞務採購的不當設計,次則因政府慣於長期使用臨時人力所造成。準此,我國宜儘早檢討公務人力應有之完整制度。

The public sectors are always approach the labor purchasing by ways of public sector's ”purchasing law” to meet their need. By this way, it is violating the article 5 and article 6 of the labor standard law (Although this kind of the labor purchasing has a favor exterior of the foreign country's labor dispatching law system), but actually it is a behavior of evade the labor standard law (Since there is no labor dispatching law system in ROC). Nevertheless, Using those dispatching labors over several years is also prohibited by the developed country's law system. This research found that this awkward situation comes from two ways, first, the injustice design of the public sector purchasing law, and second, The government accustomed to use those day labors in long terms. Eventually, it is a time for the government to examine all due haste about the complete system of the public labour.
